An incredible simple story of how fraud can be easily committed in a business. Many businesses presume that, because they've never experienced fraud, background screening isn't necessary for their organisation. Unfortunately, as we see in these stories in the press, financial crimes can happen to anyone.
👉Barista stole £4,000 after funneling money into his bank account by getting customers to pay on his own card machine More so than any other case study, this story tells us a great deal about employee risk and screening in 2024. For months Brandon Leung used his own chip and pin device to get customers to pay him, and not the business, for drinks he served. He was only caught after accidentally overcharging a customer, who then raised the alarm when he was unable to refund her. To cite the article: 'Leung, who had a past conviction for theft by an employee, admitted fraud but avoided jail as he was instead sentenced to a 12-month community order and 120 hours' unpaid work.' Once again I can play "where is the punishment?" If you take the £4,016.20 he stole and divide it by the 120 hours- that's £33.46 for each hour of work, nearly 3 times the minimum wage. Also "past conviction for theft by an employee" ... if even repeat fraudsters escape real punishment, there is little disincentive here for aspiring criminals. This is why risk and fraud are increasing. Also notable: in another 12 months, this conviction will become 'spent' and stop appearing on a basic dislcosure. A future employer in 2026 will have no idea of the risk here if they only do a criminal record check. So are background checks pointless? 🤷 No - but you do need to scale up: - An adverse media check would now find the press coverage of this event - I also noted something else 'defence lawyer Ruta Mikailaite said Leung was £2,000 in debt.' As such a credit check may have been able to identify the risk too: this is not to say all people in debt will steal, but that it is useful to know if there were any recent debt events (like CCJs) that may increase the likelyhood of someone doing something desperate. - Finally good old fashioned references would be a safeguard; I cannot imagine anyone would now vouch for Brandon. If you are only doing a basic criminal record check, your screening is insufficient for 2024. Even in a job role that is performed publicly and has little goods or cash on hand, it is still possible for a fraudster to find a way to steal. As such, good background checks are now a necessity for any business. Lastly - and a very important point - I am not suggesting that anyone with a conviction should be barred from working. Gainful employment is the best tool for rehabilitation. I do strongly believe; however, that employers should know the risks when taking someone on - especially when that employee has repeatedly stole from past employers. For example, it would foolish to put Brandon to work as an unsupervised barista without at least double-checking orders against payments. #backgroundchecks #fraud #stafftheft #vetting #dbschecks
