The Public Sector Equality Duty (PSED) mandates that public authorities and those exercising public functions consider how their decisions and policies affect people with protected characteristics. One of the key mechanisms for ensuring compliance with the PSED is conducting an Equality Impact Assessment (EIA). The charity sector, lauded for its altruistic aims and positive contributions to society, is not immune to governance failures, financial mismanagement, or improper conduct. There have been some headlines in the press where charities have got things wrong. Today is the day when after 28 years the UK sees significant changes to employment law, published in Parliament today under the Employment Rights Bill. Here are the headlines: 1. Unfair dismissal rights from day one of employment (not 2 years) with exemptions for 6/9 month statutory probationary periods. Government has not decided yet, whether to exclude 6 or 9 month probationary periods. 2. Ending exploitative zero hours contracts practices. Likely to be a requirement to fix normal hours according to reference periods of patterns of working hours. 3. Ending fire and rehire practices. 4. New day one rights for paternity, parental and bereavement leave. 5. SSP from day one of sickness absence not fourth day. Removal of lower earnings limit for all workers. 6. Default entitlement to flexible working. 7. Large employers required to create action plans to address gender pay gaps. 8. Supporting employees through the menopause. 9. Strengthened protections against dismissal for pregnant women and new mothers. 10. A new Fair Work Agency to bring together enforcement bodies to enforce rights such as holiday pay.
