I left the UK in the aftermath of Brexit to pursue a master’s degree at Germany’s most prestigious governance school, the Hertie School. I doubled down on the belief that the European Union would emerge as a regulatory superpower 🌍, especially with the gradual decline in US influence and the increasing distribution of global power. Yesterday, I had the pleasure of meeting Prof. Joanna Bryson and fellow UK-based alumni from the Hertie School at a pub in Soho 🍻. We discussed the new European AI Act and its implications. Much like with the GDPR, the European Union has taken the lead in setting global standards for AI regulation 🏆. The race is now on, with various market players and regulatory authorities working to interpret and implement the Act in ways that align with its values and objectives. Key questions remain: ❓ Will the concepts enshrined by the Act gain global recognition? ❓ How will different regions conceptualize and apply these principles? ❓ Can firms adapt quickly enough to the new regulations? ❓ Will the Act decelerate advancements in the AI field? In a meta-exercise, I chose not to answer these questions myself but instead asked ChatGPT 🤖 (full disclosure). Here are the responses: Global Recognition 🌐 The European AI Act is likely to enshrine certain concepts into law that could gain global recognition. These include transparency, accountability, fairness, and the prohibition of certain high-risk AI applications. Given the EU's influence on global regulatory practices (often referred to as the "Brussels effect"), it's probable these principles could become widely adopted or at least inform regulatory approaches in other jurisdictions. Regional Differences 🌍 While core principles may be globally recognized, their interpretation and application will vary by region, reflecting different societal values, legal traditions, and technological priorities. For example, the EU's approach may emphasize stringent privacy protections and user rights, while other regions might prioritize innovation and economic growth. Adaptation by Firms 💼 The ability of firms to adapt to the European AI Act will vary. Larger firms with more resources are likely to adapt more quickly, investing in compliance mechanisms, legal expertise, and technical adjustments. Smaller firms might face significant challenges due to resource constraints. The EU may provide guidance and support to help businesses comply. Impact on Advancement 🚀 The European AI Act might decelerate certain advancements due to increased compliance costs and development delays. However, it could also drive innovation in ethical, safe, and trustworthy AI. Companies might focus on creating AI systems that align with the regulatory framework, leading to advances in areas such as explainability, bias mitigation, and robustness. Take these insights with a pinch of salt, or not 😉 #AIregulation #EuropeanAIAct #TechPolicy #AIgovernance #DataProtection #FutureofAI #TechLaw

🔍✒️ Avoiding Costly Errors in Legal Translation: A Cautionary Tale In the realm of legal documentation, even the tiniest errors can have monumental consequences. Consider the recent case of a regional development bank that embarked on what was to be a lucrative joint venture with an electric car company, investing millions into the establishment of a cutting-edge factory. Everything seemed on track until a critical error surfaced in the translated joint venture agreement. A misplaced comma in a clause regarding liability allocation in the event of insolvency became the catalyst for a catastrophic outcome. This seemingly innocuous mistake led to the company's administrator refusing a credit claim presented by the regional development bank in the value of hundreds of millions of dollars. At the New Law Station we understand the weight of responsibility that comes with legal translation. Our team of seasoned legal professionals undergo rigorous training to grasp the intricacies and nuances of legal language.
