You may have seen the attached update which came out today from the Low Pay Commission. We know that where the NLW and NMW land are very relevant to many of our clients and contacts. The points that stood out for us were around how they will build in the cost of living - this is different to Living Wage Foundation definition They have updated their estimate of where NLW will land and project a range from £11.82 to £12.39 which is higher than they were predicting in March (under the ‘old’ remit) They are saying in 2025 they should continue to narrow the gap between the 18-20 Year Old Rate and the NLW i.e. they will not be dropping NMW to age 18 straight away What is interesting also is that they say they have until the end of October to feed back but we are expecting the Chancellor to announce the new rates in the Budget on October 30th so not much wriggle room there! Living Wage Foundation announce new Living Wage rates on 21st October. Reward Heads run forums for key sectors and have NLW and Living Wage firmly on the agenda. These Equal Pay claims have been dragging on for years so this is a significant ruling, not just for Next and its employees but for many across the sector, as there are major cases underway with most of the large supermarket chains which could impact a huge number of people. Perhaps the most significant part for those of us involved in Equal Pay reviews is the Tribunal’s rejection of ‘market rates’ as an objective justification. This comes at a time when pay transparency is a big topic- whilst there is no sign of legislation in the UK as yet, changes in the EU and US in particular are prompting many employers to ensure that they are on the front foot and begin what can be a lengthy and complicated journey to publishing pay ranges. Inexplicable! Whilst we know that NMW legislation is complex and it is easy to get tripped up, the one bit that is pretty straightforward is the headline rate. Even if there was an expectation of paying the under 21s rate, that doesn’t reconcile with asking for a degree or years of experience. Is it that they simply can’t multiply by the number of hours and number of weeks? Surely no employer is unaware of the NMW rates? Answers on a postcard!
