The Office of Rail and Road protects the interests of rail and road users, improving the safety, value and performance of railways and roads. We are responsible for ensuring that railway operators comply with health and safety law. We regulate Network Rail’s activities and funding requirements, regulate access to the railway network, license the operators of railway assets and publish rail statistics. We are the competition authority for the railways and we enforce consumer protection law in relation to the railway. We are also responsible for holding to account National Highways and its management of the strategic road network – the motorways and main 'A' roads in England.

We have published our revised Managing Rail Staff Fatigue guidance. Eryl Marsh, ORR's Head of Specialist Inspection, explains the industry's responsibilities in this area. "This revised document aims to support duty holders in complying with their legal obligations under The Health & Safety at Work Etc Act 1974, The Management of Health & Safety at Work Regulations 1999, and The Railway and Other Guided Transport Regulations 2006. "The guidance will help industry in the assessment and control of fatigue risk by updating the management system approach and integrating ORR’s ‘Fatigue Factors’. "This, in turn, will help industry identify the key features within their shift systems that increase the likelihood of fatigue, and it allows those risks to be assessed and controls identified. Optimising these factors leads to increased alertness and better health outcomes."
