    The first day of a new month 🌅 Whatever you may have planned for October we know for definite that two crucial employment legislation changes will come in to force. You can’t ignore these, they are the law. ‼️🚨 1️⃣ Tips belong to your people! The Employment (Allocation of Tips) Act 2023 mandates that all tips, gratuities, and service charges must be distributed fairly to staff. This prohibits withholding and “unfair” management practices—100% of these earnings now go to the workers. 2️⃣ Stronger protections against workplace harassment. The Worker Protection (Amendment of Equality Act 2010) Act 2023 brings heightened accountability. Employers now have a PROACTIVE duty to prevent sexual harassment, including third-party incidents. If an organisation fails to act, they could be held responsible. These changes are designed to build better workplaces, but they come with new responsibilities for employers. ⚖️ 👉 Is your business ready for these updates?     The Equality and Human Rights Commission (EHRC) has released updated technical guidance on the Worker Protection Bill, which comes in to force later this month. The guidance makes it very clear that employers are unlikely to meet the new proactive duty to prevent workplace sexual harassment without conducting a risk assessment (point 3.31). 𝐓𝐡𝐢𝐬 𝐢𝐬 𝐬𝐨𝐦𝐞𝐭𝐡𝐢𝐧𝐠 𝐰𝐞 𝐚𝐧𝐭𝐢𝐜𝐢𝐩𝐚𝐭𝐞𝐝, 𝐰𝐡𝐢𝐜𝐡 𝐢𝐬 𝐰𝐡𝐲 𝐚𝐥𝐥 𝐨𝐟 𝐨𝐮𝐫 𝐬𝐞𝐱𝐮𝐚𝐥 𝐡𝐚𝐫𝐚𝐬𝐬𝐦𝐞𝐧𝐭 𝐩𝐫𝐞𝐯𝐞𝐧𝐭𝐢𝐨𝐧 𝐥𝐞𝐚𝐫𝐧𝐢𝐧𝐠 𝐬𝐨𝐥𝐮𝐭𝐢𝐨𝐧𝐬 𝐢𝐧𝐜𝐥𝐮𝐝𝐞 𝐛𝐨𝐭𝐡 𝐩𝐫𝐞 𝐚𝐧𝐝 𝐩𝐨𝐬𝐭-𝐝𝐞𝐥𝐢𝐯𝐞𝐫𝐲 𝐢𝐦𝐩𝐚𝐜𝐭 𝐚𝐬𝐬𝐞𝐬𝐬𝐦𝐞𝐧𝐭𝐬.
