James Ward was featured in The Sunday Times article, "Inheritance tax lawyers on the big mistakes and how to dodge them". James sat down with journalist Lucy Andrews to discuss what really happens in estate disputes, how costly these arguments can be and how to avoid them. In the article, James shares insights on a sibling disagreement that resulted in a hefty bill from HM Revenue & Customs saying, “It took four years to administer the estate because the siblings couldn’t agree over who was going to get what. While they squabbled, their inheritance tax (IHT) bill was racking up, adding thousands of pounds of interest to the taxman’s coffers…. All that time, HM Revenue & Customs was owed a few million pounds’ worth of inheritance tax”. Last week we revealed the medal table which nobody wants to come top of – who pays the most inheritance tax in the UK! We found that Chichester took the honours, with 153 estates being taxed, while Kensington paid the most to the HMRC (£103m), according to the most recent HMRC data. As our Private Wealth legal expert Sophie Voelcker says, “We are advising an increasing number of clients who are looking at reducing their estates for IHT purposes and making use of available IHT exemptions pre 30 October, namely: - use of the IHT nil rate band, - annual exemption, - regular gifts out of excess income, - gifts of business or agricultural property or - potentially exempt transfers.
