Based in the Old Oak Opportunity area, the project will involve the installation of 868 high-efficiency solar panels atop an existing commercial building, projected to generate approximately 434 kW of energy.  Whilst we cherish our roots in the South West, we're proud to be able to extend our expertise across the wider UK, embracing all challenges and opportunities.   • We are proud to share another success story from the past week. Arena Global Management Ltd has been successful in removing a historic agricultural tie for a client of ours in a small village in Somerset. As part of the application, AGM submitted a Lawful Development Certificate (Existing Use) which demonstrated that the dwelling had been occupied in breach of the occupancy condition for a continuous period of more than 10-years. The application was also supported by the submission of two statutory declarations (sworn affidavits), which were drawn up by AGM and signed by the applicant. By carrying out a thorough review of the site and its background, AGM were able to uncover a variety of evidence which demonstrated to the Council that the property had been used for a number of purposes which were not strictly agricultural. This was also paired with the fact that no County Parish Holding (CPH) Number (or Holding Number) existed for the property. The Certificate of Lawfulness was granted by the Local Planning Authority after reviewing the facts and case laid out by AGM. Within their Delegated Report, the Officer comments that: “It is subsequently held that the property has been occupied in breach of the Agricultural Occupancy Condition for more than 10 years and as such continued occupation in breach of this condition is lawful. Information presented within the planning history as well as aerial imagery also indicates that agricultural occupation of the property during the past 10+ years is less than probable.” Our client is very pleased with the outcome of this application and is now able to live in the dwelling without any worry or threat of enforcement action. With the agricultural tie removed, they can now sell the property at full valuation as well. This case underscores the importance of meticulous research and a robust legal strategy in property law.   • Following our recent post, here is the story behind the Upside Down House. 🏠 The site is located in a village to the south of Bath and consists of an existing farm with ancillary farm buildings and fields, family run and dedicated to beef cattle. The client and his wife are both completely invested in the business and share the workload. They are both passionate about contributing to the local economy and creating a supportive and strong farming community. The proposal was for a 3-bedroom rural workers dwelling for the farm manager to ensure that he could be on site full-time and help the business grow and evolve. The challenge was that the site was located within the Greenbelt in an open greenfield, where development would not usually be allowed, except in special circumstances. The proposal was to create a upside down house for a reversed way of living which would assist with managing the farm. This would mean bedrooms on the ground floor along with double garage and utility room, and the kitchen, living and dining room, and the office on the first floor. The house needed to be functionally placed in close proximity to the existing farm buildings. This new dwelling will allow the client to provide better care to the 80+ cattle on site. As most calving happens at night, it is integral that the farm manager can be within sight and sound 24 hours of the day to ensure the best welfare for the cattle. The proposal was therefore developed with careful consideration of livestock requirements and keeping their safety and security at the forefront.   • Planning permissions are not unlike London buses; you can wait ages for one and then three come along at once! Arena Global Management Ltd are absolutely delighted to share the news that three planning permissions were received in the space of a single afternoon last week. This achievement is a testament to the hard work and collaboration of our dedicated team who were able to secure a positive result for our valued clients. Each permission had its own challenges and complexities which required the collective knowledge and expertise from both within the team and our trusted consultants: Class Q Barn Conversion: planning permission was secured via Class Q, Prior Approval, for the conversion of a former lambing shed to a residential dwelling. Due to the existing building’s size and presence of protected species (bats), AGM worked pro-actively with the Local Planning Authority and Ecology Department to secure the provision of a bespoke, standalone day roost. Such a compensation measure will ensure that the development is appropriately mitigated going forward. Former Public House Change of Use: planning permission was secured for the conversion of a former PH’s Ground Floor to a mixed-use scheme – providing a residential apartment and separate Class E (Offices) unit. Being within Flood Zones 2 and 3, AGM demonstrated to both the Council and Environment Agency that the scheme would not pose a risk to its residents throughout its lifetime. Furthermore, appropriate marketing evidence was submitted to the LPA, detailing how all avenues for the building’s use had been explored prior to the submission of this application. Pre-Commencement conditions: AGM was successful in discharging the necessary Pre-Commencement conditions for a mixed-use scheme within the heart of Bath. Providing the necessary and correct documentation, the LPA were able to discharge the conditions within 14-days of validation (a record time by all accounts!).     New Permitted Development Rights for Agricultural Buildings comes into force today! At Arena Global Management Ltd we have discussed this previously and how the new changes result in some excellent opportunities for our rural clients. However one potential negative result from these changes, is the decrease in maximum size allowed under Class Q conversions. Whilst the maximum number of dwellings has increased to 10 the maximum size of any one dwelling is now 150m2 reduced from 465m2. This could be a major implication in creating family size dwellings for our clients. There is however a transitional period meaning any larger conversions up to 465m2 can still be completed under Class Q up to May 2025.
