Anita Guha KC led Lubeya Ramadhan in a successful appeal to the Court of Appeal, the judgment in which was handed down yesterday. Anita and Lubeya were instructed by Simon Craddock at Brethertons Solicitors LLP. Having obtained permission to appeal on all grounds in a complex international children case where the children had been removed to this jurisdiction from Afghanistan, an application was pursued by the team to adduce fresh evidence in the case. The Court of Appeal set aside all the findings of fact made by the first instance judge and remitted the matter for a fresh hearing. The Court of Appeal were persuaded that the Ladd v Marshall principles were satisfied in admitting the fresh evidence and that the Respondent’s opposition to the appeal, upon the grounds that it was said to be academic, should be overruled. The judgment of Shehabi v The Kingdom of Bahrain [2024] EWCA Civ 1158 was handed down on the 4th October 2024, and whilst it’s gained some notoriety due its subject matter, what appears to have been overlooked is the decision indicates that victims of hacking and data theft may well have a cause of action under the Protection from Harassment Act 1997. Myself and Kiril Waite have put together a short article on the case, and its wider implications in data protection and privacy litigation, linked below. #weare7br 7BR #privacy #dataprotection #hacking
