RESUMO: O artigo apresenta de maneira sucinta a compreensão de Scheler sobre os valores, sua hierarquia, o papel do sentimento na intuição dos valores, e a importância da empatia e da simpatia como instrumentos da intersubjetividade. Os valores são a priori, intuídos pelo sentimento, e nos atos de preferir e postergar, segundo a hierarquia de valores, realizam os valores superiores. É através da empatia que o outro é reconhecido, e é através da simpatia que 'sentimos com' e 'simpatizamos com', o que permite dirigir-se aos outros e realizar emocionalmente a Humanidade. ABSTRACT: The article briefly describe Scheler's comprehension on values, its hierarchy, the role of feeling on the intuition of values, and the importance of empathy and sympathy as instruments of intersubjectivity. The values are a priori intuited by feeling, and by the acts of preferring and postponing, according to the hierarchy of values, realize the higher values. It is through empathy that the other is recognized, and it is through sympathy that it's possible to 'feel with' and 'sympathize with', which allows to direct yourself to the others and emotionally realize Humanity.

O artigo está dividido em três partes. Na primeira, dedicada aos
fundamentos ontológicos e epistemológicos, estabelecemos a diferença entre o relativismo ontológico, o relativismo gnosiológico e o relativismo irracionalista. Na segunda, a convergência relativista é evidenciada a partir de análise antropológico-filosófica. Na terceira, consideramos algumas consequências de cada um dos três tipos de relativismo.

ABSTRACT The problem of universals remains a philosophical theme not only in ontology but also in epistemology. In Husserl, there are particular universals, the noematic 'X', the identical, and universals stricto sensu, atemporal universal names. In this paper, I present the theme as it is analyzed by Husserl in Ideas I. In the first section, I describe the trajectory to the universals highlighting the parallelism between noese and noema. In the second section, I draw the reflection of this problem on the philosophy of language which is also affected by the noetic-noematic correspondence. In the third and last section, I show how the investigation about the universals moves in the noematic sphere, and conclude defending the possibility of reaching the universal strict sense departing from the noematic 'X'.

RESUMO A questão dos universais permanece tema na filosofia tanto na ontologia como na epistemologia. Em Husserl, há universais particulares, o 'X' noemático, o idêntico, e universais stricto sensu, nomes universais atemporais. Neste artigo, apresento o tema conforme analisado por Husserl em Ideias I. Na primeira seção, descrevo a trajetória até os universais destacando o paralelismo entre noese e noema. Na segunda seção, traço o reflexo para a filosofia da linguagem também afetada pela correspondência noético-noemática. Na terceira e última seção, mostro como a investigação sobre os universais move-se apenas na esfera noemática, e concluo defendendo a possibilidade de partindo do 'X' noemático alcançar o universal em sentido estrito.

In this paper, I discuss the possibility of reading the description of promise presented by Reinach in The A priori Foundations of the Civil Law under the light of Husserl's Ideas I. In order to present my argument, first, I briefly present the phenomenological method proposed by Husserl in Ideas I highlighting eidetic reduction. Second, I present the Reinachian description of social acts emphasizing the act of promising. Third, and finally, I try to demonstrate that the Reinachian description of the social act of promising is the description of a universal and necessary relation, a synthetic and a priori statement and corresponds to the idea of promise.

The aim of this investigation is to discuss the concept of realism and idealism applied to Husserlian phenomenology, distinguishing the ontological and the epistemological dimensions. Therefore, I propose questions that will help to mark this distinction. The answers will be given with reference to Husserl’s texts and commentators.

Resumen: En este artículo se presenta la diferencia entre Husserl y Frege cuanto al alcance del lenguaje. Para Frege, el lenguaje describe sentidos, para Husserl, el lenguaje describe esencias. Frege apunta para un universal sin desarrollar este concepto, ya Husserl no sólo presenta el universal, las esencias, como eleva el papel del lenguaje como el instrumento de cognición del los universales. Husserl aclara el concepto de sentido distinguido la dimensión subjetiva (noese) e la dimensión objetiva (noema) de la vivencia, así la esencia, el universal, está en la dimensión objetiva y el lenguaje es el instrumento de descripción de esta. In this paper, I present the difficulty in the phenomenology of explaining the constitution of objectivities in consciousness. In the context of phenomenological reduction, constitution has to be understood as unveiling the universal and necessary essences. Recognized by Husserl in Ideas I and named as functional problems, the constitution of objectivities refers at first to individual consciousness, and then to an intersubjective one. In Ideas II, the phenomenologist explains how the constitution of nature, psyche, and spirit occurs. This process begins by assuming three premises: the ontological realism, the regularity of nature, and the transcendental idealism. In this process, the ego, apart from constituting objects (the body, the psyche, and the others), constitutes itself. The objects of material reality are constituted through aesthetic synthesis which unifies singularities and contextualizes the lived experience. The body, as a perceptive organ, perceives the exterior, and the location of the sensory stimulus is the soul. The soul is a real and transcendent object, which is linked to physical things that are constituted in a solipsistic way or intersubjectively. Empathy allows the subject to recognize the consciousness of the alter ego as capable of spontaneous movements and actions, a co-presence sharing the same horizons. Thus, through the theoretical attitude, the physical world is perceived, and through the spiritual attitude the spiritual world is perceived, a living world shared by free intelligent beings. For this, intersubjectivity fulfills a fundamental role, because only in the relationship with the other does the identity of the objects, of the other, and of the self become evident.

Max Scheler apresentou sua formulação sobre o problema do livre arbítrio no opúsculo Phänomenologie und Metaphysik der Freiheit, de 1912-1914, publicado em Gesammelte Werke, Band X. No presente capítulo, esta compreensão é apresentada de maneira resumida e, em seguida, apreciada à luz do debate contemporâneo entre o compatibilismo e o incompatibilismo. Ao fim, se pretende justificar a hipótese de que a posição scheleriana neste debate seria em favor do incompatibilismo libertarianista.

Viktor Frankl's Logotherapy is based on Max Scheler's theory of values and anthropology. Frankl builds his psychological thinking based on critical concepts of Scheleri-an thinking such as (i) value and goods, (ii) will and feelings, (iii) the hierarchy of values, and (iv) the idea of person. It is with them that he develops his original theses of (i) the spiritual motivation of human action, (ii) the search for meaning and (iii) the spiritual unconscious. In doing so, he offered not only a psychotherapy of values, but also a new theory of positive human motivation, not conceived as a result of deficiency or need, but as a result of the free spirit toward objective values. The human search for meaning in life can only be successful by living and realizing superior values, in the hierarchical sense proposed by Scheler. Resumen: La Logoterapia propuesta por Viktor Frankl se basa en la teoría de los valores y antropología de Max Scheler. Frankl construye su pensamiento psicológico basado en con-ceptos clave del pensamiento Scheleriano como (i) valor y bienes, (ii) voluntad y sentimien-tos, (iii) la jerarquía de valores y (iv) la idea de persona. Es con ellos que desarrolla sus tesis originales de (i) la motivación espiritual de la acción humana, (ii) la búsqueda de significado y (iii) el inconsciente espiritual. Al hacerlo, ofreció no solo una psicoterapia de valores, sino también una nueva teoría de la motivación humana positiva, no concebida como resulta-do de la discapacidad o la necesidad, sino del espíritu libre dirigido a valores objetivos. La búsqueda humana de sentido en la vida solo es posible tener éxito con la experiencia y la realización de valores superiores, en el sentido jerárquico propuesto por Scheler. Resumo: A Logoterapia proposta por Viktor Frankl está fundamentada na teoria dos va-lores e antropologia de Max Scheler. Frankl constrói seu pensamento psicológico baseado em conceitos-chave do pensamento scheleriano como (i) o valor e os bens, (ii) o querer e os sentimentos, (iii) a hierarquia de valores e (iv) a ideia de pessoa. É com eles que desenvolve suas teses originais da (i) motivação espiritual da ação humana, (ii) busca de sentido e (iii) inconsciente espiritual. Ao fazê-lo, ofereceu não só uma psicoterapia dos valores, mas tam-bém uma nova teoria da motivação humana positiva, não concebida como fruto de defici-ência ou necessidade, mas do espírito livre direcionado a valores objetivos. A busca humana por sentido na vida só é possível ser bem-sucedida com a vivência e realização de valores superiores, no sentido hierárquico proposto por Scheler. Resumo: neste artigo pretendo estender a evidenciação do encobrimento do mundo da vida formulada por Husserl ao uso das tecnologias disruptivas da 4ª Revolução Industrial, mais precisamente o uso da inteligência artificial (IA) nas plataformas sociais. Primeiro, apresento o conceito de mundo da vida que se mantém consistente ao longo das obras de Husserl; em seguida, apresento seu encobrimento derivado da matematização da natureza e do rompimento com o telos, o que originou a crise da humanidade europeia. Segundo, mais camadas de encobrimento do mundo da vida vão se sobrepondo com a 3ª e 4ª RIs. Em mais detalhe, o encobrimento e o afastamento do mundo da vida provocado pelo uso da IA e seus efeitos negativos, individual e coletivamente. Terceiro, a proposta Husserliana de retorno ao mundo da vida através de uma epoché radical. Concluo que a solução proposta por Husserl para a crise ainda é atual e urgente.

Esta edição da Revista Ética e Filosofia Política tem como tema Fenomenologia e Direito. A tradição fenomenológica teve início com a publicação das Investigações Lógicas de Edmund Husserl em 1900-01 e, embora seja mais comum enfatizar a relação entre o nascimento da Fenomenologia e a Psicologia já que encontramos nas Investigações Lógicas uma forte influência de Franz Brentano e uma evidente preocupação com a definição e fundamentação desta, o Direito e temas correlatos como as normas, as leis, o Estado, a atividade judicativa, os valores e a sociedade são frequentes nos textos dos primeiros fenomenólogos do Círculo de Göttingen, incluindo o próprio Husserl.

Neste artigo pretendo evidenciar como a relação entre sujeito anímico e sujeito espiritual é fundamental para a compreensão da intersubjetividade e do mundo da vida (Lebenswelt). Em Ideias II, Husserl explica como, a partir do eu, sujeito e objeto são constituídos no mundo: natureza, alma e espírito. Estes três estratos do sendo são conhecidos a partir da atitude teorética e da atitude espiritual e, no processo, se dá a explicitação do eu. Numa atitude teorética, temos constituição da natureza, para o que o corpo (Körper/Leib) é fundamental. Em seguida, a constituição de objetos de natureza anímica, humana ou animal, incluindo a autopercepção. Assumindo a atitude espiritual, o outro é percebido (Urpräsenz), inicialmente, como corpo junto às coisas e, ao lado desta percepção, há uma apercepção (Appräsenz) dos horizontes co-dados. Há uma identidade entre o corpo alheio e o meu, é o momento da empatia (Einfühlung). O mundo constituído a partir de uma atitude naturalista ou teórica é uma redução do mundo circundante (Umwelt), mas o mundo cotidiano da atitude personalista ou espiritual lhe antecede, o mundo vital (Lebenswelt). É, portanto, através da atitude personalista ou espiritual, que se constitui uma comunidade de sujeitos espirituais.

In this article I intend to highlight how the relationship between psychic subject and spiritual subject is fundamental for the understanding of intersubjectivity and the life world (Lebenswelt). In Ideas II, Husserl explains how, from the self, subject and object are constituted in the world: nature, soul and spirit. These three strata of the being are known from the theoretical attitude and the spiritual attitude and, in the process, the self is explicit. In a theoretical attitude we have nature's constitution, for which the body (Körper / Leib) is fundamental. Then the constitution of objects of animic nature, human or animal, including self-perception. Assuming the spiritual attitude, the other is perceived (Urpräsenz) initially as a body together with things, and beside this perception there is an apprehension (Appräsenz) of co-given horizons.
