This concluding chapter provides an overview of the chapters, as well as briefly highlighting the... more This concluding chapter provides an overview of the chapters, as well as briefly highlighting the relevant normative frameworks applicable to the issues addressed in this special edition journal. The authors have addressed structural, institutional, and individual gaps and challenges in the refugee protection sphere and have raised concerns about the lack of adequate acknowledgement of gendered aspects of the asylum frameworks and processes, and crucially the differential impact thereof. The gaps in the legally binding instruments governing this area of human rights protection, and the minimal attention to the connection between theory and practice and its resulting consequences, are highlighted by some authors.

To do so, it examines its policy activities, including the adoption of resolutions on thematic or specific country situations, and also through the reports emanating from selected Commissions of Inquiry. Moreover, it considers the reports presented to the HRC by mandate holders in the Special Procedures system. Drawing on these documents, this chapter provides insights into the HRCs level of engagement and monitoring of the WPS agenda. In doing so, it highlights their capacity to hold states accountable for ensuring the human rights of citizens, and women’s human rights in particular. Analysis of the HRCs monitoring and reporting mechanisms suggests that while the intrinsic link between human rights and WPS is acknowledged, the implications of this relationship are not effectively addressed. Despite normative standards having been set, the reality is that violence against women remains a global epidemic, which is further complicated when considering multiple and intersecting forms of discrimination. This thematic report examines such discrimination in the context of violence against women and provides a conceptual framework for further discussion. The report acknowledges the reality that while multiple and intersecting forms of discrimination have contributed to and exacerbated violence against women, information on the intersections between gender-based discrimination and other forms of discrimination, and the consequences thereof, are too often overlooked. Women's activism in South Africa is closely intertwined with the complex political history of resistance. The inherited legacy of the past, particularly for black women, includes oppression and discrimination based on gender but also on factors such as race, class, religion, ethnicity and geographic location. These factors have all played a role in shaping women's struggles against oppression and discrimination. It has been argued that race and class divisions have differentially shaped the political consciousness of women. For example, white middle-class women's struggles were largely focused on issues of political equality and their legal status, while the political struggles for black women involved ...
