Hope Behind Bars Africa observed the ongoing proceedings for indigent protesters represented by Peace Adewuyi, Esq, and Esther Chiemeka, Esq.
The Court delivered its ruling on the Variation of Bail Application. The 3rd, 6th, 8th, 10th, and 11th defendants, unable to meet the previous bail condition of 10 million Naira and secure relatives with certificates for landed properties, were granted relief.
The new bail conditions are as follows:
1. 5 million Naira for each Defendant.
2. One surety, a respectable Nigerian citizen and a blood relation of each defendant, must depose to an affidavit.
3. The Defendants are prohibited from participating in protests, public gatherings, or rallies pending the case’s outcome.
The Court emphasized that the defendants must attend all court sessions and promised an expedited trial. The matter has been adjourned to November 8, 2024, for Trial.
We are pleased with this progress. The Administration of Criminal Justice Act, 2015, grants the Court the discretion to vary bail conditions based on the circumstances of each case. Bail not only lightens the financial burden of tracking and monitoring defendants but also upholds their right to be presumed innocent while awaiting trial.
