The academic concept of »History of Knowledge« or »Wissensgeschichte« is still evolving, especial... more The academic concept of »History of Knowledge« or »Wissensgeschichte« is still evolving, especially in the field of social studies such as jurisprudence, within which the branch of private law forms a more particular area. The paper attempts to find abstract answers to the question of which features of the methodology of »Wissensgeschichte« can be considered specific to that of private law. It finds that a person-centred historiog-raphy concentrating on the personal development, professional career, and evolving theses of the scholars (jurists), is not obsolete and outdated, so far as legal historians have regard to some corrective factors. The peculiarities of the history of knowledge of private law are reinforced by its special intellectual-historical aspects, because applied-scientific pragmatics and broad abstractions are necessarily connected therein, since it reflects the social, economic and political facts and relations, and, also influences them. The mentioned supplementary or corrective factors follow these particularities. The study uses the example of the 2500 years of history of private law thinking in Hungary, the cornerstones of which are its most important Aauthorities. Since the paper uses the complexity of social, economic, political, and law-based facts of history merely as tools for showing a knowledge-historical method in the field of a national private law, it seemed acceptable to use a Hungarian authority as source of these facts and of the selection of persons: The recent book by Lajos Vékás. It does not mean at the same time, that this article would avoid or ignore the critical approach. Despite Hungarian private law regulations are pregnant with sharp political twists and turns, the scholar-portraits show a peculiar continuity of private law of Hungary that was almost unique among the countries of the so-called socialist block. If a thing is sold before either it comes into existence or it is got by the vendor, the buyer ma... more If a thing is sold before either it comes into existence or it is got by the vendor, the buyer may assume the full risk of the thing’s coming into existence as well as its obtaining by the vendor, consequently the price must be paid even if no result emerges. The contract of this kind was elucidated by the Roman jurists as a spei emptio, in which, according to subsequent doctrinal explanations, the hope of the future acquisition (spes) and the risk of the transaction (alea) can be interpreted either as the subject or the motive of the transaction. There are some analogous transactions, in which the parallel character is expressed by our legal sources, and there can be discovered some other, in the case of which the analogy is based merely on the similarities of risks but not on the letters of our sources. The concept of spei emptio has survived and transformed in the European Continental legal thinking. While English case law knows the issue of «purchase of a chance», and some Authorities of jurisprudence also acknowledge the existence of «hope rights» and of the «sale of an expectation», such sales are regulated in statutory laws of England under the concept of the sale of future goods but not as sale of hope or chance. Both in federal and state level, the legal systems of the United States drew extensive inspirations from the English and the Continental legal tradition as well, and, according to this, the ideas thereof emerge like karst springs both in the jurisprudence, and in the statutory as well as case law of the US. The original Continental concept may have been adopted, remodeled, reinvented, unlearned, omitted, or deliberately abolished by legal thinking of US-States. The article can be assigned both to legal history and legal theory since the analogous issues of legal thoughts may be based either on historical continuity or on the independent albeit parallel development of law.

A tanulmány összehasonlító jogtörténeti tárgyú, amely a „jogélet” szociológiai nézőpontjából teki... more A tanulmány összehasonlító jogtörténeti tárgyú, amely a „jogélet” szociológiai nézőpontjából tekint rá a szorult helyzetben cselekvő adósok vagyonkimentő aktusainak, illetőleg az efféle, a hitelezőket megkárosító ügyletek jogi ’antidotumainak’ ókori római előzményei re, valamint kortárs problémáira. A szerző korábbi, ez irányú kutatásait továbbfejlesztve és aktualizálva felveti, hogy az ókori római jogélet vizsgálata a jogrend reagálóképessége – és a reakció mibenléte – tekintetében a jövő szolgálatába állítható. Pillanatfelvétel módjára rátekint az USA, Németország, Franciaország és az EU-jog legújabb vonatkozású, tárgybeli jogalkalmazási vagy jogalkotási problémáira, és az azokra adandó választ az összehasonlító jogtörténet eszközével a római jogi források alapján azonosítható fedezetelvonási gyakorlatra adott ókori jogalkotói reflexiók nyomán kirajzolódó képben ragadja meg – a komparatisztikai elemzés eredményeit három komplementer diagramban is összefoglalva.

Eörsi-Jubilee 100/30, or ‘The Fate of Hyperion’: An Island of Serenity en Route from Blind Faith ... more Eörsi-Jubilee 100/30, or ‘The Fate of Hyperion’: An Island of Serenity en Route from Blind Faith to Breach with Himself: Gyula Eörsi on Scandinavian Law. The vita of the world-renowned Hungarian professor of Private Law, Gyula Eörsi began a century, and ended three decades ago in the extremely sad and painful circumstances of morbus Alzheimer attacking the mind of a genius. In terms of the productivity, quality, and impact of his œuvre, Eörsi was one of the greatest teachers, researchers, and codifiers of private law of his age, not only in the domestic context but also on the international stage of legal unification (Chairmanship of the UN Diplomatic Conference that created the CISG). This Jubilee Paper analyses a book by Eörsi that seems to be free of the communist ideological ‘straitjacket’ that he voluntarily put on at the beginning of his career, but which ultimately may have ruined his life. This book, which have peculiarly never been reviewed, was published in 1974 in Hungarian language “On Scandinavian Law and Jurisprudence”. For all contracts, the risk component is either the initial lack or the subsequent disruption of ... more For all contracts, the risk component is either the initial lack or the subsequent disruption of the value balance of services. Determining the conditions under which the value of the service and the consideration at the time of the contract's conclusion (as a matter of invalidity) or at the time of the performance (as a matter of breach of contract) can be in proper balance may be both a legislative and an enforcement issue. If the band, within or around which the difference between the two values is not considered to be legally undesirable, is defined by the legislator, there is no discretion left to the application of the law. However, in the case of a generalised rule, i.e., where the legislator does not define disproportionality in terms of a specific ratio or range of values, it is at the discretion of the jurisdiction to decide on the question of proportionality. The rules of invalidity and of breach of contract as traffic safety criteria are expressly excluded by law for certain types of contracts, while in other cases, the law expressly authorises the parties to exclude these guarantee rules for their legal relationship by their commercial will, since their interests are precisely directed towards a higher degree of risk-taking. Where these rights are not based on law, the parties' contractual intention must include the assumption of these rights. In the continental-rooted civil codes of the US-State of Louisiana, the problem is based on a body of law being fairly similar to that of Austria: Even the wording of the codes' provisions is somehow identical. At the same time, it is remarkable that, compared to this legal environment, judicial thinking in litigation before the courts of the highest instances greatly differs.

Paulianische Anfechtungsklage (actio Pauliana), die auch in den heutigen europäischen Privat- und Insolvenzrechtsordnungen eine wichtige Rolle einnimmt, ist der erstrangige Rechtsbehelf im Bereich Gläubigerschutzrecht gegen betrügerischen Deckungsentzug. Die Fundamente jener Institution wurzeln tief im Recht der römischen Republik und Kaiserzeit. Dieser Aufsatz zeigt, dass der Zwölfkolumnentext des Stadtrechts von Gortyn als Zeitgenosse des römischen Zwölftafelgesetzes einen Institutionsvorgänger bietet. In Anbetracht der weitschweifenden, bunten Kasuistik der Generalklauseln des Paulianischen Edikt erwies sich die actio Pauliana als ein außergewöhnlich wirkungsvolles und überlebensfähiges Rechtsmittel, da die paulianische Klage nicht nur im Falle von betrügerischen gläubigerschädigenden privatrechtlichen Geschäften und öffentlich-¬rechtlichen Rechtsakten , sondern auch bei fraudulösen Realakten griff. Die in den Digestentitel 42.8 aufgenommene reichhaltige kaiserzeitliche Kasuistik des Paulianedikts kann heutzutage von drei verschiedenen Rechtsgebieten abgedeckt werden — soll heißen, dass die modernen Fälle des gläubigerwidrigen-betrügerischen Schuldnerverhaltens unter die Tatbestände sowohl des geltenden Privat- und Insolvenzrechts als auch des Strafrechts subsumiert werden können. Nach dem in der zwischen der 20. und 25. Zeile der zehnten Kolumne stehende Fragment (X, 20–25) der großen Inschrift von Gortyn war die dorisch-kretische Stadt schon im 5. Jahrhundert v. Chr. im Stande, ein durch Schenkungsverbot wirkendes Gläubigerschutzrecht von solcher Qualität zu entwickeln, dass es einen Vergleich mit den in allgemeiner Weise formulierten Regeln der Paulianischen Anfechtungsklage heutiger Rechtssysteme von Europa bestehen kann.

A Pécsi Ítélőtábla egy döntése nyomán a hazai bírósági gyakorlatban először került sor a 2013. év... more A Pécsi Ítélőtábla egy döntése nyomán a hazai bírósági gyakorlatban először került sor a 2013. évi Ptk. új bevezető rendelkezésének, a venire contra factum proprium tilalmának [1:3. § (2) bek.] az ügy eldöntése szempontjából jelentős alkalmazására. A másodfokú bíróság a tilalmat helyesen alkalmazta, az ugyancsak helyesen levont jogkövetkezmény jogi indokolása azonban feleslegesen utalt a joggal való visszaélés tilalmára [1:5. § (1) bek.]. Ha ugyanis a fél a perbeli védekezése során az ellenérdekű fél jogainak tagadása körében olyan tartalmú nyilatkozatot tesz, amely szemben áll olyan korábbi magatartásával, amelyben a másik fél okkal bízhatott, az a Ptk. 1:3. § (2) bekezdésébe ütközően a jóhiszeműség és tisztesség követelményét [1:3. § (1) bek.] sérti, melynek szankciója az, hogy a bíróság a döntést e védekezés figyelmen kívül hagyásával hozza meg. A Kúria ítéletében mellőzte az új Ptk.-ra való hivatkozást, és arra utalt, hogy az ekként értékelt magatartás az 1959. évi Ptk.-ban foglalt nemo auditur suam turpitudinem allegans elv [4. § (4) bek. II. mondata] alapján ítélendő meg. Az eseti döntés rámutat a Ptk. bevezető rendelkezéseiben revelálódó általános polgári jogi elvek konkurenciájának már 1965-ben felvetett, helyes jogértelmezéssel azonban rendre feloldható problémájára, valamint a pusztán a bevezető rendelkezést sértő, más speciális jogszabályba nem ütköző magatartások anyagi jogban nem szabályozott, ezért szükségképpen az alaki jogban érvényesülő szankciójának kérdésére.

A dolgozat azt vizsgálja, miként vélekedett a hazai magánjogi gondolkodás a társadalmi-gazdasági ... more A dolgozat azt vizsgálja, miként vélekedett a hazai magánjogi gondolkodás a társadalmi-gazdasági átalakulás, illetve a technológiai fejlődés által teremtett valóságos joghézagok oly módon történő kitöltésének lehetőségéről, amely a „cessante ratione legis non cessat lex ipsa” régi elvében gyökerezik. Eszerint: „a törvény indítóokának megszűnése nem ejti el magát a törvényt”. Vagyis elképzelhető, hogy a törvény eredeti motívuma megszűnt, illetőleg az jelentősen megváltozott, mégis képes az eredeti norma új törvény megalkotása nélkül is kielégíteni azt a szabályozási igényt, amelyet az új helyzet megkíván. Vagyis nem áll fenn látszólagosan sem a cessatio legis.

The medical content of the concept of fetal genetic or teratological harm, or of a disorder incom... more The medical content of the concept of fetal genetic or teratological harm, or of a disorder incompatible with postnatal life, which is a legal condition of the right of self-determination to terminate pregnancy granted until the 20th/24th week of pregnancy or without time limitation in Hungary, is changing as medical science and diagnostics evolve. Medical bodies, legislature, and judiciary – as well as families – need to reflect on this fundamental issue of society. The article draws lessons and makes recommendations based on the results obtained in the investigation of the practice of the Supreme Court (now: Kúria) and Regional High Courts of Appeal in cases decided between 2015 and 2021. In the exercise of rights and in the performance of duties, the requirement of good faith and fai... more In the exercise of rights and in the performance of duties, the requirement of good faith and fair dealing encompasses the entire Hungarian legal system. In private law, including business relations, it has absolute priority. The exact determination of the content of the principle codified in Art. 1:3(1) of the Hungarian Civil Code required not only grammatic-logical and systematic-authentic interpretation but necessitated also a historical and comparative legal analysis. However, the usual, complex interpretation of norms could not lead to the pragmatically desirable result that the courts applying the codified norm do need. In order to achieve this goal, it was inevitable to examine in particular the treasures handed down to us from the philosophical, legal and religious-ethical intellectual complexes of the European intellectual heritage. The paper summarises the sources, functions and species (types) of Hungarian private law’s genera... more The paper summarises the sources, functions and species (types) of Hungarian private law’s general principles. It emphasises that the non-legal basis thereof consists in the Common European Cultural Heritage (as Greek philosophy, Roman law, Judeo-Christian religious tradition, Humanism, Enlightenment). Thereafter, the contribution analyses the interdependence and mechanisms of action of the governing principles of Rule of Law and Justice. The study shows that, on the one hand, among homogeneous relationships and circumstances, Justice operates as the Rule of Law, while, in heterogeneity, it is the Equity, which performs the Rule of Law by means of correction of Justice: Both Justice and Equity guarantee the perpetuance of Rule of Law, which has a certain predominance according to the previous two principles. If a thing is sold before either it comes into existence or it is got by the vendor, the buyer ma... more If a thing is sold before either it comes into existence or it is got by the vendor, the buyer may assume the full risk of the thing’s coming into existence as well as its obtaining by the vendor, consequently the price must be paid even if no result emerges. The contract of this kind was elucidated by the Roman jurists as a spei emptio, in which, according to subsequent doctrinal explanations, the hope of the future acquisition (spes) and the risk of the transaction (alea) can be interpreted either as the subject or the motive of the transaction. There are some analogous transactions, in which the parallel character is expressed by our legal sources, and there can be discovered some other, in the case of which the analogy is based merely on the similarities of risks but not on the letters of our sources. The concept of spei emptio has survived and transformed in the European Continental legal thinking. While English case law knows the issue of «purchase of a chance», and some Authorities of jurisprudence also acknowledge the existence of «hope rights» and of the «sale of an expectation», such sales are regulated in statutory laws of England under the concept of the sale of future goods but not as sale of hope or chance. Both in federal and state level, the legal systems of the United States drew extensive inspirations from the English and the Continental legal tradition as well, and, according to this, the ideas thereof emerge like karst springs both in the jurisprudence, and in the statutory as well as case law of the US. The original Continental concept may have been adopted, remodeled, reinvented, unlearned, omitted, or deliberately abolished by legal thinking of US-States. The article can be assigned both to legal history and legal theory since the analogous issues of legal thoughts may be based either on historical continuity or on the independent albeit parallel development of law.

A szerző korábbi, ez irányú kutatásait továbbfejlesztve és aktualizálva felveti, hogy az ókori római jogélet vizsgálata a jogrend reagálóképessége – és a reakció mibenléte – tekintetében a jövő szolgálatába állítható. The vita of the world-renowned Hungarian professor of Private Law, Gyula Eörsi began a century, and ended three decades ago in the extremely sad and painful circumstances of morbus Alzheimer attacking the mind of a genius. In terms of the productivity, quality, and impact of his œuvre, Eörsi was one of the greatest teachers, researchers, and codifiers of private law of his age, not only in the domestic context but also on the international stage of legal unification (Chairmanship of the UN Diplomatic Conference that created the CISG). This Jubilee Paper analyses a book by Eörsi that seems to be free of the communist ideological ‘straitjacket’ that he voluntarily put on at the beginning of his career, but which ultimately may have ruined his life. This book, which have peculiarly never been reviewed, was published in 1974 in Hungarian language “On Scandinavian Law and Jurisprudence”. For all contracts, the risk component is either the initial lack or the subsequent disruption of ... more For all contracts, the risk component is either the initial lack or the subsequent disruption of the value balance of services. Determining the conditions under which the value of the service and the consideration at the time of the contract's conclusion (as a matter of invalidity) or at the time of the performance (as a matter of breach of contract) can be in proper balance may be both a legislative and an enforcement issue. If the band, within or around which the difference between the two values is not considered to be legally undesirable, is defined by the legislator, there is no discretion left to the application of the law. However, in the case of a generalised rule, i.e., where the legislator does not define disproportionality in terms of a specific ratio or range of values, it is at the discretion of the jurisdiction to decide on the question of proportionality. The rules of invalidity and of breach of contract as traffic safety criteria are expressly excluded by law for certain types of contracts, while in other cases, the law expressly authorises the parties to exclude these guarantee rules for their legal relationship by their commercial will, since their interests are precisely directed towards a higher degree of risk-taking. Where these rights are not based on law, the parties' contractual intention must include the assumption of these rights. In the continental-rooted civil codes of the US-State of Louisiana, the problem is based on a body of law being fairly similar to that of Austria: Even the wording of the codes' provisions is somehow identical. At the same time, it is remarkable that, compared to this legal environment, judicial thinking in litigation before the courts of the highest instances greatly differs.

Paulianische Anfechtungsklage (actio Pauliana), die auch in den heutigen europäischen Privat- und Insolvenzrechtsordnungen eine wichtige Rolle einnimmt, ist der erstrangige Rechtsbehelf im Bereich Gläubigerschutzrecht gegen betrügerischen Deckungsentzug. Die Fundamente jener Institution wurzeln tief im Recht der römischen Republik und Kaiserzeit. Dieser Aufsatz zeigt, dass der Zwölfkolumnentext des Stadtrechts von Gortyn als Zeitgenosse des römischen Zwölftafelgesetzes einen Institutionsvorgänger bietet. In Anbetracht der weitschweifenden, bunten Kasuistik der Generalklauseln des Paulianischen Edikt erwies sich die actio Pauliana als ein außergewöhnlich wirkungsvolles und überlebensfähiges Rechtsmittel, da die paulianische Klage nicht nur im Falle von betrügerischen gläubigerschädigenden privatrechtlichen Geschäften und öffentlich-¬rechtlichen Rechtsakten , sondern auch bei fraudulösen Realakten griff. Die in den Digestentitel 42.8 aufgenommene reichhaltige kaiserzeitliche Kasuistik des Paulianedikts kann heutzutage von drei verschiedenen Rechtsgebieten abgedeckt werden — soll heißen, dass die modernen Fälle des gläubigerwidrigen-betrügerischen Schuldnerverhaltens unter die Tatbestände sowohl des geltenden Privat- und Insolvenzrechts als auch des Strafrechts subsumiert werden können. Nach dem in der zwischen der 20. und 25. Zeile der zehnten Kolumne stehende Fragment (X, 20–25) der großen Inschrift von Gortyn war die dorisch-kretische Stadt schon im 5. Jahrhundert v. Chr. im Stande, ein durch Schenkungsverbot wirkendes Gläubigerschutzrecht von solcher Qualität zu entwickeln, dass es einen Vergleich mit den in allgemeiner Weise formulierten Regeln der Paulianischen Anfechtungsklage heutiger Rechtssysteme von Europa bestehen kann.

A Pécsi Ítélőtábla egy döntése nyomán a hazai bírósági gyakorlatban először került sor a 2013. év... more A Pécsi Ítélőtábla egy döntése nyomán a hazai bírósági gyakorlatban először került sor a 2013. évi Ptk. új bevezető rendelkezésének, a venire contra factum proprium tilalmának [1:3. § (2) bek.] az ügy eldöntése szempontjából jelentős alkalmazására. A másodfokú bíróság a tilalmat helyesen alkalmazta, az ugyancsak helyesen levont jogkövetkezmény jogi indokolása azonban feleslegesen utalt a joggal való visszaélés tilalmára [1:5. § (1) bek.]. Ha ugyanis a fél a perbeli védekezése során az ellenérdekű fél jogainak tagadása körében olyan tartalmú nyilatkozatot tesz, amely szemben áll olyan korábbi magatartásával, amelyben a másik fél okkal bízhatott, az a Ptk. 1:3. § (2) bekezdésébe ütközően a jóhiszeműség és tisztesség követelményét [1:3. § (1) bek.] sérti, melynek szankciója az, hogy a bíróság a döntést e védekezés figyelmen kívül hagyásával hozza meg. A Kúria ítéletében mellőzte az új Ptk.-ra való hivatkozást, és arra utalt, hogy az ekként értékelt magatartás az 1959. évi Ptk.-ban foglalt nemo auditur suam turpitudinem allegans elv [4. § (4) bek. II. mondata] alapján ítélendő meg. Az eseti döntés rámutat a Ptk. bevezető rendelkezéseiben revelálódó általános polgári jogi elvek konkurenciájának már 1965-ben felvetett, helyes jogértelmezéssel azonban rendre feloldható problémájára, valamint a pusztán a bevezető rendelkezést sértő, más speciális jogszabályba nem ütköző magatartások anyagi jogban nem szabályozott, ezért szükségképpen az alaki jogban érvényesülő szankciójának kérdésére.

Eszerint: „a törvény indítóokának megszűnése nem ejti el magát a törvényt”. Vagyis elképzelhető, hogy a törvény eredeti motívuma megszűnt, illetőleg az jelentősen megváltozott, mégis képes az eredeti norma új törvény megalkotása nélkül is kielégíteni azt a szabályozási igényt, amelyet az új helyzet megkíván. Vagyis nem áll fenn látszólagosan sem a cessatio legis.

Medical bodies, legislature, and judiciary – as well as families – need to reflect on this fundamental issue of society. The article draws lessons and makes recommendations based on the results obtained in the investigation of the practice of the Supreme Court (now: Kúria) and Regional High Courts of Appeal in cases decided between 2015 and 2021. In private law, including business relations, it has absolute priority. The exact determination of the content of the principle codified in Art. 1:3(1) of the Hungarian Civil Code required not only grammatic-logical and systematic-authentic interpretation but necessitated also a historical and comparative legal analysis. However, the usual, complex interpretation of norms could not lead to the pragmatically desirable result that the courts applying the codified norm do need. In order to achieve this goal, it was inevitable to examine in particular the treasures handed down to us from the philosophical, legal and religious-ethical intellectual complexes of the European intellectual heritage. It emphasises that the non-legal basis thereof consists in the Common European Cultural Heritage (as Greek philosophy, Roman law, Judeo-Christian religious tradition, Humanism, Enlightenment). Thereafter, the contribution analyses the interdependence and mechanisms of action of the governing principles of Rule of Law and Justice. The study shows that, on the one hand, among homogeneous relationships and circumstances, Justice operates as the Rule of Law, while, in heterogeneity, it is the Equity, which performs the Rule of Law by means of correction of Justice: Both Justice and Equity guarantee the perpetuance of Rule of Law, which has a certain predominance according to the previous two principles.
