The Agri-Food and Evironmental Law (AgLAW) Research Team engages in exploring innovative legal and policy tools for improving environmental, social and economic sustainability of global food systems. Our research considers interconnections, synergies and trade-offs between different patterns that directly or indirectly affect food systems in an extremely integrated and complex scenario. Our current research interests revolve around different key areas dealing with international, regional (mainly EU) and national regulatory frameworks that govern agriculture and food systems: - Mitigation and agricultural adaptation to climate change. - Ecosystem-based approach in agriculture and its role in protecting, managing, and restoring habitats. - Agricultural digitalization and Earth Observation. - The One Health policy approach. - Food Commons and Sustainable and Alternative Food Systems. - International trade rules.

On October 16, World Food Day, Brazil 🇧🇷 introduced the 3rd National Plan for Agroecology and Organic Production (PLANAPO). This plan supports sustainable food systems by promoting healthy food production, environmental protection, and agroecological transitions through various programs and initiatives. 👩🌾 PLANAPO policies encourage climate adaptation, conservation, and sustainable development to improve Brazilians' quality of life. The Plan also focuses on empowering family farms, agrarian reform settlements, and traditional communities to secure food sovereignty for the population. 🌟 Key initiatives include: * Agroecological transition incentives: Financial support for farmers shifting to agroecological practices. * Research and innovation: Support research and technology development focused on advancing agroecology. * Public procurement: Integrating agroecological food into public programs. * Sustainability and environmental conservation: agricultural practices to protect biodiversity and natural resources. * Social inclusion: Promoting equity by involving women, youth, Indigenous people, and quilombolas. 📌 On the same day, Brazil launched the “Food on the Plate” (Planaab) plan, focusing on sustainable food supply, strengthening family farms, and supporting vulnerable communities. Additionally, an interministerial decree introduced the Arroz da Gente Program to boost rice production and stockpiling. Through this program, small and medium rice producers can sign option contracts with the government to support their production efforts. ⚖🥩🫛 The CJEU recently issued its judgment regarding the French decree that aimed to restrict the use of meat-related terms for plant-based products. The court ruled that since France has not yet defined legal names for terms traditionally linked to animal-based foods, it cannot prevent plant-based product manufacturers from using those terms. This case, initially brought by organizations such as the European Vegetarian Union, Association Protéines France, and the U.S. company Beyond Meat, will now be referred back to the French Council of State (Conseil d’Etat) for a final ruling. While the ruling offers Member States a pathway to establish legal names, it also serves as a clear warning: bans on specific terms cannot be arbitrarily imposed without proper legal justification. This decision raises important questions: Will this lead to harmonization challenges across the EU? And are consumers able to clearly differentiate between plant-based and animal-based products? 🚨 EU Deforestation-free Regulation (EUDR) Postponed 📌 On October 2nd, the European Commission proposed delaying the EUDR by 12 months, moving its start date from December 31, 2024, to December 30, 2025, for large companies and June 30, 2025, for small and medium companies. 👩🌾 The EUDR, with a novel character, aims to prevent deforestation by requiring proof that commodities like soy, beef, palm oil, and coffee sold or exported from the EU are not linked to recently deforested land or forest degradation. 🖋️ This delay follows concerns about readiness from multiple global partners. The extra year is intended to ensure smooth and effective implementation. In addition to proposing to postpone, the Commission presented a guidance document for an effective and pragmatic implementation of the Regulation. 👩⚖️The proposal has yet to be approved by the European Parliament and Council. With the imminent conclusion of the first Von der Leyen Commission, it's an opportune moment to reflect on the legacy of the European #GreenDeal To begin this discussion, the first AgLaw seminar of the academic year focused on “The Effort Sharing Regulation and LULUCF Regulation – Bold Amendments Under Fit for 55?”. The seminar explored the Fit-for-55 package’s potential to align livestock GHG emissions mitigation with the broader 2030 and 2050 targets set by the Green Deal and the European Climate Law. Speakers Roberto Talenti and Valentina De Gregorio highlighted that, despite initial promising proposals for revised Effort Sharing and LULUCF regulations, a significant U-turn occurred during the approval of the final amended versions in 2023. Currently, targets for reducing livestock GHG emissions (responsible for over 80% of EU agricultural emissions) are spread across two separate regulatory frameworks. Most fall under the ESR, which sets relatively weak targets, includes flexible mechanisms, and allows for wide "inter-sectoral compensation." As a result, it’s unlikely to significantly reduce livestock emissions.
