The Federal Trade Commission (FTC) has recently signed a settlement order with Mariott Inc., along with 49 other state governments. The company was accused of multiple data breaches over a period of six years where bad actors were able to access millions of consumer records in a profiled manner. Some of the settlement terms include: 1) The company establishes, implements and maintain a comprehensive information security program that protects the security, confidentiality, and integrity of personal information wherever such information is collected and processed. 2) An assessment should be conducted as far as internal and external risks to the security is concerned related to the confidentiality and integrity of Personal Information. 3) The company should conduct a third-party verification of the procedures and standards adopted in an independent manner. 4) The company would pay $52 million as settlement amount for the case. The European Court of Justice (ECJ) has recently held that the European Commission cannot scrutinize mergers which are neither beyond the thresholds mentioned in the EU, nor on a country-specific basis. The interpretation given by the EC and GC in the Illumina-Grail case to the merger regulations risk upsetting the balance between various objectives pursued by it and impinge upon the guarantee of foreseeability and legal certainty for the undertakings concerned. The European Commission (EC) has initiated regulatory dialogue with Apple Inc. under Article 8(2) of the Digital Markets Act (DMA) for effective implementation of the law. The purpose of this dialogue is to highlight specific obligations which would need compliance as far as interoperability is concerned. The dialogue is organised under two headers, i.e. interoperability for iOS connectivity features and functionalities, and the process which has to be setup as far as requests made by developers and third parties sre concerned. The said proceedings have begun on the discretion of the EC where the Commission seeks to 'assist' the smartphone maker in compliance as a soft-law measure. The Union cabinet in India has recently accepted 'One nation, One election' suggesting simultaneous polls for national and state assemblies. The government has announced that an implementation group would be formed which will have detailed consultation with the concerned stakeholders to take forward the suggestions made by the panel. The General Court in the EU has recently set-aside the EC's decision in the Google AdSense case. The GC has held as follows, among other things: a) The Commission has not established that the three clauses that it had identified - exclusivity clause, placement clause and prior authorization clause - each constituted an abuse of a dominant position and together constituted a single and continuous infringement of Article 102 TFEU as per the requisite legal standard. In such a case, the Commission’s decision is annulled in its entirety. b) The EC has committed errors in its assessment of the duration of the referred clauses at issue, as well as of the market covered by them in 2016. The European Court of Justice (ECJ) has upheld the contravention decision passed by the European Commission against Google Inc. for abusing its dominance in several markets and imposing a fine of €2.4bn. The Court of Justice has stated that while it cannot be considered that, as a general rule, a dominant undertaking indulging in self-preferencing is a deviation from competition on merits, in the present case, it finds that it is established that, in the light of the characteristics of the market and the specific circumstances of the case, Google’s conduct was discriminatory and did not fall within the scope of competition on the merits. The Competition and Markets Authority (CMA), UK has followed suit in opening an investigation against Google Inc. for potentially violating competition law in the Advertisement Technology (AdTech) space along with the US, EU and India. The CMA has provisionally held that, since at least 2015, Google has abused its dominant positions through the operation of both its buying tools and publisher ad server in order to strengthen AdX’s market position and to protect AdX from competition from other exchanges. This is ultimately disadvantageous to competitors, publishers and advertisers who could offer better and more competitive services supporting growth in their businesses.
