Prisoners serving long sentences in Ireland face a significant setback in their rehabilitation journey. Due to delays in drafting regulations, many inmates who should be eligible for parole are unable to apply. The 2019 Parole Act established clear eligibility criteria but its implementation has stalled leaving many prisoners in a state of uncertainty. While life-sentence prisoners can apply for parole after serving 12 years, those with non-life sentences who have served 8 or more years find themselves in limbo. This delay impacts approximately 50 prisoners annually who would have been eligible under the previous system. Moreover, the holdup is exacerbating the issue of prison overcrowding, with facilities currently operating at 110% capacity. These challenges highlight the urgent need for the finalisation and implementation of the parole regulations. We urge the Department of Justice to prioritize drafting these crucial regulations. These programs highlight the controlled access police forces provide to the media, usually expecting favourable coverage, leaning more towards securocratic propaganda rather than holding broadcasters accountable for investigative journalism. The media rarely criticizes the Gardaí, leading to a lack of scrutiny and accountability. Without this critique, people might not fully grasp the challenges in law enforcement. Despite these developments, challenges remain: - The process is still complicated for practitioners, partly due to member states interpreting principles in a domestic rather than EU law context - There are ongoing issues with inadequate completion of forms and tables, as well as translation quality - The need for intensive fact-specific inquiries and communications between judicial authorities persists It's worth noting that the European Commission has recently criticized Ireland's new legislation on European Arrest Warrants, citing concerns about alignment with EU requirements. We can confirm the case of Cork Republican Sean Walsh who is sought by authorities in the North for extradition with the view of being charged for terrorist related offences arising from an MI5 covert surveillance operation in County Tyrone, appeared before the case management list than the Supreme Court in Dublin on Tuesday. This matter previously appeared before the Grand Chamber of the European Court of Justice in June whereby clarification was sought in respect to the Trade & Cooperation Agreement compatibility given amendments to Terrorist legislation sentencing remits in the UK. This case will now appear for a further hearing before the Supreme Court presided by Chief Justice O’Donnell on 24th of September 2024. The Criminal Assets Bureau (CAB) with wide ranging and draconian powers is intensifying its efforts to combat organised crime, with 1,450 targets under investigation across Ireland and abroad. Since its establishment in 1996, CAB has recovered over €210 million for the State, demonstrating its crucial role in dismantling criminal networks. CAB's multifaceted approach includes proceeds of crime investigations, tax assessments, and social welfare probes. With plans to expand to 160 staff, CAB continues to adapt and grow in its fight against organized crime. It is concerning that such detailed data is readily available to friendly journalists and tabloids, while defence lawyers face significant obstacles in accessing information crucial to their clients' cases. This disparity in information accessibility raises serious questions about the balance of justice and the principle of equality of arms in the legal system. It also flags the toxic culture of Garda leaks and unlawful disclosures which is a violation of the DPAs & the Garda Síochána Act. The legal community must address this discrepancy to ensure that all parties in the judicial process have equal access to relevant information as opposed to defence discourse received piecemeal via the tabloid media Transparency and accountability in the criminal justice system is severely lacking. This issue calls for a reassessment of information-sharing policies within the justice system to maintain the integrity of legal representation and uphold the principles of justice.
