The EU General Data Protection Regulation (GDPR) was published in the Official Journal of the European Union on 4 May 20163. It comprises a new right to data portability for individuals which requires data controllers to ensure that they can hand over the personal data they possess about a consumer in a usable and transferable format. The right to data portability under Article 20 of the GDPR will, for example, allow a Facebook user to migrate their Facebook profile, photos, updates and other personal data to Google+. This article elaborates how the right to data portability in the GDPR needs to be assessed in the light of, and if necessary complemented by, existing EU competition rules. It suggests that some lessons can be drawn from EU competition law to limit the potential adverse impact of the data portability provision particularly for small and medium-sized enterprises, and that EU competition rules especially Article 102 TFEU and the essential facilities doctrine can complement and strengthen data portability by facilitating mandatory access to specific data.

The GDPR comprises a new right to data portability for individuals, which requires data controllers to ensure that they can hand over the personal data that has been provided by the data subject himself/herself, in a structured, commonly used and transferable format. This paper critically examines the right to data portability and suggests that in order to ensure comprehensive data portability that reaches out to all relevant stakeholders, including businesses, the provisions in the GDPR need to be analysed by taking into account EU competition rules. It suggests that lessons can be drawn from EU competition law to limit the potential adverse consequences of the right to data portability particularly for small and medium-sized enterprises. It also asserts that EU competition rules, especially Article 102 TFEU and the essential facilities doctrine, can complement data portability by facilitating mandatory access to specific data.

In December 2015, the European Commission proposed a new Directive for the Supply of Digital Content. This Directive was presented along with a second proposed Directive on Online and Distant Sale of Goods. These proposed Directives form part of the European Union Digital Single Market Strategy. This paper critically examines the Directive for the Supply of Digital Content to establish whether it fits the purposes for which it is drafted and whether it fits the goals of the Digital Single Market Strategy.
It is submitted that although the Directive is presented as part of the Digital Single Market Strategy and as an instrument to fill a gap in the Consumer Acquis, it is mainly concerned with harmonising contract law and it is driven by the Commission’s previous failed attempts to harmonise Contract law. The paper also highlights that in its current form due to some of its requirements imposed on businesses the proposed Directive may lead to unintended consequences for consumers. The paper argues that the Directive and some of its provisions needs to be revisited.

En Occident, les femmes ont été largement sous-représentées dans la communauté psychédélique tout comme dans les études scientifiques portant sur cette classe de psychotropes. En effet, les caricatures de l’utilisatrice diffusées dans les médias ou dans les productions artistiques (sur sexualisée, disponible sexuellement) ainsi que l’axe systématiquement sanitaire des études menées sur les consommatrices de psychotropes, rendent particulièrement difficile à repérer et à analyser les usages féminins de psychédéliques. Par ailleurs, les chercheuses et thérapeutes ayant participé à la première vague d’études sur ces produits (1950-1970) ont été invisibilisées par l’historiographie (1,2).
Cette situation mène aujourd’hui à une absence de reconnaissance des apports et des réflexions scientifiques féminines sur ces substances (3), ainsi qu’à une méconnaissance des besoins (4) et des expériences spécifiques des femmes usagères (5). Comme l’explique l’historienne Erika Dyck, « l’histoire des psychédéliques en est venue à privilégier les perspectives masculines », déformant notre compréhension de ces substances.
Faisant le constat de la rareté des travaux ayant pour ambition de questionner les psychédéliques du point de vue du genre ou cherchant à étudier les contributions et les expériences des femmes dans ce domaine, nous souhaitons proposer dans ce webinaire un panel visant à combler ce manque. Nous étudierons ainsi les biais concernant les savoirs académiques en lien avec l’usage féminin de psychotropes, nous mettrons en lumière les rôles historiques et contemporains des femmes dans le champ des psychedelic studies, et nous questionnerons les pratiques genrées liées à l’usage de ces substances.
