  • The California Attorney General has issued new legal advisories outlining the obligations of businesses and healthcare entities deploying or relying on AI. These advisories emphasize that AI systems must align with a variety of state regulations, including: ➡️ 𝗖𝗼𝗻𝘀𝘂𝗺𝗲𝗿 𝗣𝗿𝗼𝘁𝗲𝗰𝘁𝗶𝗼𝗻 𝗟𝗮𝘄𝘀 Entities must comply with California’s Unfair Competition Law (Business & Professions Code §17200), ensuring AI use does not amount to unlawful, unfair, or fraudulent business practices. ➡️ 𝗗𝗮𝘁𝗮 𝗣𝗿𝗶𝘃𝗮𝗰𝘆 𝗥𝗲𝗴𝘂𝗹𝗮𝘁𝗶𝗼𝗻𝘀  The California Consumer Privacy Act (CCPA) requires transparency in AI data use and respect for consumer data privacy rights. The Confidentiality of Medical Information Act (CMIA) also has an impact on AI use, including the need to obtain consent before using sensitive information like patient or genetic data. ➡️ 𝗔𝗻𝘁𝗶-𝗗𝗶𝘀𝗰𝗿𝗶𝗺𝗶𝗻𝗮𝘁𝗶𝗼𝗻 𝗟𝗮𝘄𝘀   In view of California’s Unruh Civil Rights Act (Civil Code §51) and other anti-bias rules, AI systems must not perpetuate discrimination in healthcare, employment, or other contexts. Organizations should be particularly cautious when deploying or relying on automated decision-making. ➡️ 𝗛𝗲𝗮𝗹𝘁𝗵𝗰𝗮𝗿𝗲 𝗥𝗲𝗴𝘂𝗹𝗮𝘁𝗶𝗼𝗻𝘀  Under recent amendments to the Knox-Keene Act, healthcare plans using AI for decision-making must ensure tools are non-discriminatory, transparent, and do not override licensed providers’ decision-making. In addition, new legislation specific to AI has recently been passed in California. Key highlights include: Assembly Bill 2013: This bill outlines AI developer disclosure requirements about data sets used for AI training.  Senate Bill 942: This bill mandates that developers create accessible tools to identify AI-generated content and help distinguish it from human-generated content.  Assembly Bill 1836: This bill prohibits the use of a deceased individual’s digital likeness without prior consent within 70 years of their death. It specifically protects the rights of deceased personalities whose names, images, or likenesses have commercial value. VeraSafe is here to help you navigate compliance.   • The U.S. data privacy landscape continues to evolve as we step into 2025. Organizations should take note of the following developments: ➡️ 𝐂𝐂𝐏𝐀 𝐀𝐦𝐞𝐧𝐝𝐦𝐞𝐧𝐭𝐬 𝐀𝐫𝐞 𝐍𝐨𝐰 𝐄𝐟𝐟𝐞𝐜𝐭𝐢𝐯𝐞 The California Consumer Privacy Act (CCPA) amendments, effective January 1, 2025, introduce expanded definitions of personal information, explicitly including data in AI systems. Among other updates, these amendments also impose new responsibilities on businesses acquiring personal data via mergers, acquisitions, or bankruptcies. Ensuring compliance with pre-existing consumer opt-out preferences for the sale or sharing of personal data is now required. ➡️ 𝐓𝐡𝐞 𝐑𝐢𝐠𝐡𝐭 𝐭𝐨 𝐂𝐮𝐫𝐞 𝐄𝐧𝐝𝐬 𝐢𝐧 𝐂𝐨𝐥𝐨𝐫𝐚𝐝𝐨 𝐚𝐧𝐝 𝐂𝐨𝐧𝐧𝐞𝐜𝐭𝐢𝐜𝐮𝐭 The grace periods allowing businesses to address violations under Colorado and Connecticut’s privacy laws have expired. Enforcement actions can now proceed without prior warnings, heightening the need for proactive compliance. ️➡️ 𝐍𝐞𝐰 𝐒𝐭𝐚𝐭𝐞 𝐏𝐫𝐢𝐯𝐚𝐜𝐲 𝐋𝐚𝐰𝐬 𝐢𝐧 𝐄𝐟𝐟𝐞𝐜𝐭 The privacy laws of Delaware, Iowa, Nebraska, and New Hampshire are now enforceable. Businesses must check whether they are covered by any of these laws and align their data practices with the applicable requirements. ➡️ 𝐎𝐩𝐭-𝐎𝐮𝐭 𝐑𝐮𝐥𝐞𝐬 𝐀𝐫𝐞 𝐄𝐱𝐩𝐚𝐧𝐝𝐢𝐧𝐠 Businesses subject to the privacy laws of Montana, Connecticut, New Hampshire, or Texas must implement mechanisms to honor consumer opt-out rights effectively. Organizations should confirm that GPC signals are automatically applied for users in the relevant states. ➡️ 𝐌𝐢𝐧𝐧𝐞𝐬𝐨𝐭𝐚’𝐬 𝐃𝐚𝐭𝐚 𝐏𝐫𝐨𝐭𝐞𝐜𝐭𝐢𝐨𝐧 𝐀𝐬𝐬𝐞𝐬𝐬𝐦𝐞𝐧𝐭 (𝐃𝐏𝐀) 𝐑𝐞𝐪𝐮𝐢𝐫𝐞𝐦𝐞𝐧𝐭𝐬 Minnesota's privacy law now requires organizations to conduct DPAs for specific high-risk processing activities. These assessments evaluate the risks associated with processing personal data and the measures in place to mitigate these risks.
