    📚 Anti-suit injunctions 2.0 - need for a new approach in Germany? Dr. Vanessa Ludwig, Dr. Nikita Malevanny and I are thrilled to share our latest publication with LexisNexis examining a pivotal decision by the Higher Regional Court of Düsseldorf (Oberlandesgericht Düsseldorf ). In its June 17, 2024 ruling, the Court dismissed an appeal challenging a lower court’s refusal to issue an “anti-anti-suit injunction.” This injunction was sought to prevent the enforcement of a St. Petersburg Arbitration Court decision, which ruled in favor of the Respondent, imposing an anti-suit injunction and a potential fine for non-compliance, aimed at stopping the ongoing #arbitration in Sweden. Key Takeaways: 👉The #Court ruled that filing an anti-suit injunction in Russia does not inherently constitute a tortious act. 👉The decision reinforced that such injunctions do not infringe on the right to access German courts, as the prohibition was directed at arbitration proceedings „outside“ Germany. 👉The violation of the arbitration agreement was not deemed morally indecent since the anti-suit injunction is a recognized remedy under Russian law. The Court rejected a claim under Section 826 BGB, stating that merely failing to comply with a contractual obligation by suing in Russia was not immoral.     Over 30 students and law clerks took the opportunity to get expert tips from five speakers at the “Internship Insights: A Guide for German Law Students Seeking U.S. Internships” event recently hosted by our Munich office and the Deutsch-Amerikanische Juristen-Vereinigung (DAJV e.V.) - German-American Lawyers' Association. Sarah Sammeck, Project Manager, DAJV Internship Service, explained the DAJV internship program. Sebastian Klein, BSc, a law student at Bonn University, shared lessons learned from his DAJV internship in Atlanta, Georgia. From Keith Calhoun-Senghor, a lecturer at Bonn University, and Nicole Thomsen, Gibson Dunn Recruiting Manager, the participants learned critical tips on applying for an internship or clerkship in the U.S. and Germany. The highlight of the evening was a simulated interview led by Gibson Dunn partner Dr. Markus Nauheim, LL.M. (Duke), a member of the DAJV Executive Committee, and Selma Er of the DAJV Student Division in Munich. Everyone later got together on the Gibson Dunn roof terrace to network and exchange even more information.
