It is always an honour and a privilege to represent the Office of the Privacy Commissioner of Canada/Commissariat à la protection de la vie privée du Canada, particularly at events such as the Privacy Symposium that bring together some of the smartest, most passionate and influential leaders in our field. The week started with a discussion on Privacy and Democracy with a common recognition that protecting and promoting the fundamental right to privacy is intrinsically linked to democracy and the rights associated with democratic societies: liberty, freedom of thought, of association, of speech. Inspiring speeches by Guido Scorza, Anna Colaps and Josefina Román Vergara of the Instituto Nacional de Transparencia, Acceso a la Información y Protección de Datos Personales (INAI) amongst many others. It was a highlight for me to introduce the video remarks of Commissioner Philippe Dufresne, who spoke of the role of privacy authorities play in ensuring democratic rights are protected and of the Joint Statement he issued with UN Special Rapporteur Ana Brian Nougrères (https://lnkd.in/e9QJphJQ). The week continued with an opportunity to share regulatory developments in Canada on a panel hosted by Irish Commissioner Dr. Des Hogan of the Data Protection Commission Ireland and Kazim Rizvi, who provided insight on India’s road to a data privacy regime. Then a fantastic discussion on children’s privacy and EdTech with leading experts in the field, including Jasmina Byrne, Emma Day, Alison Howard, and Zelda Gerard. It was an opportunity to hear what is being done in this space and to share the fabulous work being done by my OPC colleagues both domestically and internationally with regard to young person’s privacy - including our recently launched exploratory consultation on the privacy implications of age-assurance systems (https://lnkd.in/ei-Qyvtt). This was followed by a panel on the Joint Statement on Data Scraping (https://lnkd.in/ecPnfY9M). Chaired by one of my favorite people, Commissioner Brent Homan of Guernsey, who guided a great conversation with Claudia Berg, Tobias Judin 🏳️🌈 and Catherine Lennman on how this initiative has had a positive effect on both regulators and companies. Last but not least was a panel on cross-border accountability with Fabrice Naftalski, Shannon Coe and Alain Herrmann that showcased some great cross-Atlantic cooperation. The week was greatly enriched by numerous exchanges, many facilitated by the immense convening power of Sébastien Z. and his fabulous team. Superb organization of so many moving parts and a testament to their ability to build bridges and create spaces for meaningful conversations. A big shout out to Rhys P. and Laura Langeveld for their support and to the entire OPC team of experts whose work it was an honour to represent.

Yesterday CIPL’s Natascha Gerlach CIPP/E chaired a discussion at the Privacy Symposium on the Digital Markets Act's (DMA) impact on consumers. The engaging discussion, joined by Mikołaj Barczentewicz, marco scialdone, and Thomas van der Valk, explored various perspectives on the DMA. Key points discussed included: • The DMA is a clear reflection of the realisation that (personal) data has economic value. • While the DMA has significant potential to positively impact the European digital market, it might also result in some notable asymmetries. For example, while gatekeepers are prohibited from cross-using or combining data, other non-gatekeeper services or search engines with large user bases will not be subject to the same prohibitions. • Although not intended, the DMA might have negative impacts on safety and cybersecurity. Therefore, the regulator must clarify this, as recommended in the CIPL paper https://lnkd.in/eKaVeMre. • It remains to be seen if data portability provisions will have the desired effect. Some panellists questioned the market demand for such provisions, based on the GDPR data portability experience. CIPL has been exploring this topic as well: https://lnkd.in/gzm9bMtf • Questions have been raised about whether the DMA might ultimately reinforce gatekeeper positions due to data portability and interoperability provisions. As a result, in certain instances, users might not see the added value in switching to a non-gatekeeper service. Thank you to the panellists for joining!

Two years after my first participation in the Privacy Symposium, this year I had the opportunity (and honor) to organize a Data Breach Simulation session during the event. Working in the setting of the Scuola Grande di San Giovanni Evangelista was amazing, as was everyone who actively participated in our session where I could see 5 teams of experts with different backgrounds and who had never worked together support each other to find solution to a very complex situation. I thank all the participants for coming and embarking on this new experience, I hope they were able to gain new knowledge and treasure the exchange of ideas opinions and solutions we had.
