Ports Strike USA East Coast and Gulf of Mexico Ports Dear Valued Clients,   Please be advised that deugro may be unable to timely perform its obligations due to an industry-wide port workers’ strike along the United States East Coast and Gulf of Mexico Ports (“the Strike”). On October 1, 2024, the International Longshoremen’s Association (the “ILA”) commenced a strike due to failed negotiations with the United States Maritime Association (the “USMX”). The two parties have been in negotiations to discuss changes to the terms of their agreement, which covers approximately 45,000 port workers. The contract terminated on September 30, 2024, and at this time, neither party has been able to reach an agreement. As a result of the Strike, thirty-six (36) ports along the United States East Coast and the Gulf of Mexico (the “Affected Ports”) have effectively shut down, resulting in delays which may affect deugro’s ability to perform. deugro is now forced to declare the Strike a force majeure event, which excuses deugro’s performance obligations during this time. Due to the Strike deugro may incur additional costs outside of its performance and may be unable to meet certain obligations within the time frame originally agreed upon. Please rest assured that deugro intends to make all commercially reasonable efforts to mitigate the effects of the Strike in alignment with your feedback and further instructions. deugro hopes to ensure resumption of normal performance as soon as reasonably practicable.
