A “morte” do Direito causada pelo próprio sistema legal tem sido tema de minha pesquisa e acredito que é necessário entendermos os mecanismos que podem impedir o abuso de poder, por aqueles que têm dever de preservar o Estado de Direito. “Abuse of Power and State of Exception” Abstract: This article explores the issue of abuse of power in the judiciary, using Giorgio Agamben’s concept of the state of exception as a theoretical reference. The aim is to analyze how judicial power can be exercised in an arbitrary manner, subverting the original intention of the laws and compromising justice. The methodology employed includes a bibliographical review of Agamben’s work, accompanied by historical and contemporary case studies that illustrate the abusive use of the state of exception and field research into people’s perceptions of the judiciary. Specific examples include arbitrary judicial decisions and undue interventions in public policy. The results show that such abuses of power not only undermine public confidence in the judicial system, but also exacerbate inequalities and perpetuate injustices, leading to a delegitimization of the rule of law. It is concluded that it is imperative to implement structural reforms and strengthen control and transparency mechanisms to prevent the abuse of judicial power, ensuring that the judicial system functions in a fair and equitable manner. What is the best #technological solution that #Brazil should promote at #COP30 in 2025? We have spent an entire semester working on a sustainable and technological solution to fix #climate change, based on the concept of ‘Fixing the tragedy of the commons: a practical solution to climate change.’ It is possible to redefine our practices towards the #global economy, on behalf of a better world for the next generation. The climate crisis stands as one of the most pressing #challenges of our time, characterized by rising global #temperatures, extreme weather events and widespread #ecological disruption. At the heart of this crisis lies a fundamental flaw in our global economic system: the inability to internalize the external costs of #carbon dioxide emissions. I am incredibly grateful to my amazing #team: Benjamin David Auer, Felipe Camps, Leonardo Rubio Malvessi, Stefano Marcondes and Victor Camargo Levy for their dedication, #collaboration, and hard work in turning our ideas into a concrete proposal. It has been an amazing journey of #research, #innovation, and dedication, where every challenge became an opportunity to #grow together. On May 23, at the 13th Summit on Anti-Corruption, Integrity & ESG in São Paulo, organized by American Conference Institute , I had the pleasure of interviewing Luiz Navarro, the Chief Compliance and Risks Officer at BNDES. In the aftermath of the Car Wash operation, BNDES faced challenges in regaining relevance and reputation. Luiz emphasized the importance of implementing stricter internal controls and compliance measures to rebuild trust and transparency. BNDES is focusing on strengthening due diligence procedures and assessing the severity of red flags to mitigate risks in financing decisions. BNDES is actively exploring mitigation strategies and corrective action plans for companies with red flags, aiming to harmonize compliance requirements with business imperatives. One notable shift is that companies seeking BNDES credit lines will now be required to present their compliance programs. This move aligns with BNDES's commitment to upholding integrity and aligning with regulatory standards. It is expected that BNDES will adhere to the guidance provided by the CGU (Controladoria-Geral da União) to enhance its compliance practices further. Overall, my interview with Luiz Navarro shed light on the proactive measures BNDES is taking to navigate the evolving compliance landscape and ensure responsible financing practices. I'm proud to see Brazilian schools in the Financial Times 2024 global ranking of the best executive education courses, with a highlight on Fundação Dom Cabral (FDC), which occupies the 5th position. The São Paulo School of Business Administration of Fundação Getulio Vargas (FGV Eaesp) and Insper are the other two Brazilian institutions on the list. In the ranking of "in company" courses, FDC also stands out, occupying the 10th position. Insper appears in the 55th position and FGV in the 81st. The ranking is based on various criteria, including the interaction between client and school, course flexibility, teaching methods, teaching quality, relevance of skills acquired for the workplace, diversity in faculty nationality and gender, and the percentage of female participants. May marks our third month diving into discussions with the B20 Task Forces and the Action Council. It's a key time for Chairs, Co-Chairs, and members as we review the latest draft of recommendations for the G20. Here are two insights from the process so far: 1. Business leaders acknowledge that global challenges are well identified. What we need now is action. Concrete proposals are essential to tackle these issues. 2. The big task is pinpointing the actions that will make a real difference toward our goals. Choosing the most effective strategies and measure their impact is the real challenge. As we keep pushing these global initiatives forward, I’d like the PMOs in our B20 Secretariat team to share two key takeaways from their experience in these groups.
