Drebers ruling: The Court of Justice confirms that a taxpayer can apply the 15-year VAT adjustment period to claim a VAT adjustment in his favour in the case of major renovation works to an existing building. This is the case even if those works do not result in the construction of a new building from a VAT perspective but have the effect of making the economic lifetime of the building, once the works have been carried out, similar to that of a newly constructed building. The Court thus rejects the traditional position of the Belgian VAT authorities and accepts that the VAT Directive has direct effect on this point, so that the taxpayer can rely on the VAT Directive to obtain a VAT adjustment in his favour. In this important case for Belgian VAT practice, the Court fully supports the position taken by Svjatoslav Gnedasj, Korneel Decroix and Herbert Casier on behalf of our client. #eubelius #VAT #tax
