  • 🚨 𝐒𝐩𝐨𝐭𝐥𝐢𝐠𝐡𝐭 𝐨𝐧 𝐃𝐋𝐂 𝐜𝐚𝐬𝐞 𝐜𝐚𝐫𝐝𝐬 - 𝐋𝐚𝐧𝐝𝐦𝐚𝐫𝐤 𝐂𝐚𝐬𝐞 #𝟑: 𝐋𝐢𝐞𝐛𝐡𝐞𝐫𝐫 🚨 In today’s legal update we highlight the Liebherr case! 𝐊𝐄𝐘 𝐅𝐀𝐂𝐓𝐒 📌 • In early 2021, Liebherr, a German retailer of household appliances, introduced sales contracts including a new rebate scheme. • The German Federal Cartel Office (‘FCO’) investigated the rebate scheme, finding that the conditions for online sales were significantly more demanding than those for offline sales, disadvantaging both online and hybrid retailers. For example, online shops had to ensure a specific delivery timeframe for out-of-stock products ordered by customers, provide various payment options and a helpdesk had to be reachable between 9am and 8pm on Sundays and holidays. 𝐂𝐎𝐍𝐂𝐋𝐔𝐒𝐈𝐎𝐍 ⚖️ The FCO found no objective justification for these practices and deemed them obstructive to online distribution. Liebherr agreed to align online performance criteria with those for offline sellers, leading to the termination of the investigation.   • 𝐄𝐱𝐜𝐥𝐮𝐬𝐢𝐯𝐞 𝐛𝐫𝐨𝐚𝐝𝐜𝐚𝐬𝐭𝐢𝐧𝐠 𝐥𝐢𝐜𝐞𝐧𝐬𝐞𝐬: 𝐧𝐞𝐰 𝐝𝐞𝐯𝐞𝐥𝐨𝐩𝐦𝐞𝐧𝐭𝐬 𝐢𝐧 𝐒𝐥𝐨𝐯𝐚𝐤𝐢𝐚 The Antimonopoly Office of the Slovak Republic has recently concluded its investigation into the retransmission of Czech TV broadcasts in Slovakia. The case touches on important issues around exclusive broadcasting licenses. Our latest article, written by our Slovak contributor HAVEL & PARTNERS, explores the Authority’s findings and recommendations.   • 🔍 𝐒𝐩𝐨𝐭𝐥𝐢𝐠𝐡𝐭 𝐨𝐧 𝐃𝐋𝐂 𝐜𝐚𝐬𝐞 𝐜𝐚𝐫𝐝𝐬 - 𝐋𝐚𝐧𝐝𝐦𝐚𝐫𝐤 𝐂𝐚𝐬𝐞 #𝟐: 𝐀𝐜𝐭𝐢𝐨𝐧 𝐒𝐩𝐨𝐫𝐭 𝐯 𝐍𝐢𝐤𝐞 (𝟐𝟎𝟎.𝟐𝟑𝟏.𝟕𝟔𝟒/𝟎𝟏) 🔍 Time to highlight another case card! Are you familiar with the Dutch Action Sport v. Nike case? 𝐊𝐄𝐘 𝐅𝐀𝐂𝐓𝐒 📌 • Nike terminated its distribution agreement with its Italian distributor Action Sport for breaching its selective retailer distribution policy by selling Nike products on Amazon, which was an unauthorized platform. • The policy stipulated that distributors could only sell products online through their own websites, authorized resellers, or authorized third-party platforms. By not adhering to this, Action Sport breached its distribution agreement. • Action Sport contested the termination, arguing that Nike’s selective distribution system did not meet the Metro criteria and violated Article 6 of the Dutch Competition Act, as Nike’s products are not luxury items. 𝐂𝐎𝐔𝐑𝐓 𝐑𝐔𝐋𝐈𝐍𝐆 ⚖️ Both the District Court of Amsterdam (October 2017) and the Court of Appeal (July 2020) ruled in favor of Nike, determining that their selective distribution policy did not constitute a hardcore restriction. The Court of Appeal hereby referenced to the ECJ’s Coty judgment clarifying that selective distribution systems are not limited to luxury products.     𝐑𝐞𝐬𝐚𝐥𝐞 𝐩𝐫𝐢𝐜𝐞 𝐦𝐚𝐢𝐧𝐭𝐞𝐧𝐚𝐧𝐜𝐞 𝐢𝐧 𝐭𝐡𝐞 𝐅𝐫𝐞𝐧𝐜𝐡 𝐰𝐢𝐧𝐞 𝐢𝐧𝐝𝐮𝐬𝐭𝐫𝐲 🍷 On 17 July 2024 the French Competition Authority has imposed a 500,000 EUR fine on Domaine d’Uby and its parent company for engaging in resale price maintenance. This decision follows an investigation into practices between March 2015 and October 2018. Domaine d’Uby imposed recommended resale prices on its distributors, restricting their pricing freedom. The Authority’s investigation also revealed that non-compliant distributors faced penalties, including delayed deliveries. 🌐 Interested to read more about this case?   • 🔍 𝐒𝐩𝐨𝐭𝐥𝐢𝐠𝐡𝐭 𝐨𝐧 𝐃𝐋𝐂 𝐜𝐚𝐬𝐞 𝐜𝐚𝐫𝐝𝐬 - 𝐋𝐚𝐧𝐝𝐦𝐚𝐫𝐤 𝐂𝐚𝐬𝐞 #𝟏: 𝐁𝐨𝐨𝐤𝐢𝐧𝐠.𝐜𝐨𝐦 (𝐊𝐕𝐑 𝟓𝟒/𝟐𝟎) 🔍   Did you know that the Distribution Law Center's platform features crisp and easy-to-understand case cards of landmark cases in the field of distribution law?   This summer, we will highlight some of the cases from our collection.   First up is the 2021 landmark decision on Booking.com’s narrow best price clause.   𝐊𝐄𝐘 𝐅𝐀𝐂𝐓𝐒 📌    • Booking.com applied a narrow best price clause which restricted hotels from offering more competitive prices or better conditions on their own websites, offline and on competing platforms compared to Booking.com’s platform.    • In 2015 the German Federal Cartel Office prohibited Booking.com from continuing to apply such clause.  • While the Higher Regional Court of Düsseldorf initially overturned the Federal Cartel Office’s decision, the German Federal Court of Justice reinstated it, declaring that such narrow best price clause breached Article 101(1) TFEU.  • The Federal Court of Justice concluded that the clause was not a necessary ancillary restraint for Booking.com’s primary activity, and therefore, not exempted from Article 101(1) TFEU.   👉 Interested in more details?
