    𝐁𝐫𝐮𝐬𝐬𝐞𝐥𝐬-𝐂𝐚𝐩𝐢𝐭𝐚𝐥 𝐑𝐞𝐠𝐢𝐨𝐧 𝐧𝐞𝐰 𝐫𝐞𝐠𝐮𝐥𝐚𝐭𝐨𝐫𝐲 𝐟𝐫𝐚𝐦𝐞𝐰𝐨𝐫𝐤 𝐨𝐧 𝐞𝐜𝐨𝐧𝐨𝐦𝐢𝐜 𝐦𝐢𝐠𝐫𝐚𝐭𝐢𝐨𝐧: 𝐩𝐮𝐛𝐥𝐢𝐜𝐚𝐭𝐢𝐨𝐧 𝐨𝐟 𝐭𝐡𝐞 𝐟𝐢𝐧𝐚𝐥 𝐩𝐢𝐞𝐜𝐞 𝐨𝐟 𝐭𝐡𝐞 𝐩𝐮𝐳𝐳𝐥𝐞 Like the Flemish Region and the Walloon Region, the Brussels-Capital Region is currently reshaping its regulatory framework on economic migration.   The aim is to modernise the current framework, to make it consistent and to simplify it, in order to better respond to the labour shortages identified on the employment market.   An ordinance and an executive decision of the Brussels government implementing these changes have already been published in the Belgian Official Gazette.   The Brussels-Capital Region had yet to publish a final executive decision listing, by category of foreign workers, the various documents required to be attached to the work permit application. This ministerial decree was published in the Belgian Official Gazette on 13 September, making the new legal framework complete.   The new legislation will come into force on 1 October 2024. #economicmigration #Brussels #claeysengels

    What a spectacular 𝑺𝒖𝒏𝒅𝒂𝒚 𝑭𝒖𝒏𝒅𝒂𝒚 we had at the magnificent 𝑪𝒉â𝒕𝒆𝒂𝒖 𝒅𝒆 𝒍𝒂 𝑹𝒐𝒄𝒒! Not only did we enjoy a rare weather miracle – sunshine ☀️ right when we needed it – but we also packed the day with fun activities for everyone 🎉   From epic laser games 🔫 and soothing sound baths to bouncing around in the bouncy castle and getting creative with balloon modeling, it was a blast!   Kids dazzled with face paint and bracelet designing, while others joined in on classic folk games.   Thanks to everyone who made this day so special: our people and their family members!     𝐓𝐡𝐞 𝐁𝐞𝐥𝐠𝐢𝐚𝐧 𝐃𝐚𝐭𝐚 𝐏𝐫𝐨𝐭𝐞𝐜𝐭𝐢𝐨𝐧 𝐀𝐮𝐭𝐡𝐨𝐫𝐢𝐭𝐲 𝐡𝐚𝐬 𝐢𝐦𝐩𝐨𝐬𝐞𝐝 𝐚 𝐟𝐢𝐧𝐞 𝐨𝐟 𝟒𝟓.𝟎𝟎𝟎 𝐄𝐔𝐑 𝐨𝐧 𝐚 𝐜𝐨𝐦𝐩𝐚𝐧𝐲 𝐟𝐨𝐫 𝐭𝐡𝐞 𝐮𝐬𝐞 𝐨𝐟 𝐚 𝐟𝐢𝐧𝐠𝐞𝐫𝐩𝐫𝐢𝐧𝐭 𝐬𝐜𝐚𝐧𝐧𝐞𝐫 𝐢𝐧 𝐭𝐡𝐞 𝐰𝐨𝐫𝐤𝐩𝐥𝐚𝐜𝐞 The company primarily deployed the fingerprint scanner for the purpose of time registration. However, during the course of the procedure, it also cited the prevention of fraud, safety concerns, and access control as supplementary purposes.   The Belgian DPA has confirmed that the use of a fingerprint scanner to identify employees is considered to constitute a processing activity concerning biometric data. Accordingly, the fundamental prohibition on processing of sensitive data applies, except in instances where the company could demonstrate a legal basis and an exception ground.   The company invoked a number of legal bases throughout the procedure, but ultimately concluded that the sole legal basis upon which it relied was that of the employees' consent. The Belgian DPA reaffirmed its position, aligning with the view of the European Data Protection Board, that consent within the employee-employer relationship is rarely an appropriate legal basis due to the inherent power imbalance.   In conclusion, the Belgian DPA ruled that the processing activity was unlawful. During its investigation, the Belgian DPA also identified several other infringements. Consequently, the company was fined 45.000 EUR.   This decision serves to illustrate the Belgian DPA's strict stance on this matter. The Belgian DPA will not accept the use of a biometric system for the above purposes unless there is an explicit legal basis or substantial public interest. #privacy #GDPR #biometricdata #claeysengels

    𝐀𝐜𝐜𝐢𝐝𝐞𝐧𝐭 𝐢𝐧𝐬𝐮𝐫𝐚𝐧𝐜𝐞 𝐟𝐨𝐫 𝐬𝐞𝐥𝐟-𝐞𝐦𝐩𝐥𝐨𝐲𝐞𝐝 𝐩𝐥𝐚𝐭𝐟𝐨𝐫𝐦 𝐰𝐨𝐫𝐤𝐞𝐫𝐬: 𝐝𝐞𝐭𝐞𝐫𝐦𝐢𝐧𝐚𝐭𝐢𝐨𝐧 𝐨𝐟 𝐭𝐡𝐞 𝐦𝐢𝐧𝐢𝐦𝐮𝐦 𝐜𝐨𝐧𝐝𝐢𝐭𝐢𝐨𝐧𝐬 The Labour Deal provided that digital platforms are required to take out an accident insurance in the interest of their self-employed workers to protect them from bodily harm resulting from accidents during work and on the way to and from work.   Digital platforms that do not take out such accident insurance are civilly liable for damages suffered.   The royal decree laying down the minimum conditions for insurance contracts that operators of digital platforms must enter into for self-employed workers of these platforms was published in the Belgian Official Gazette on 4 September 2024. These conditions must ensure a level of protection of at least an equivalent level to that provided by the Law of 10 April 1971 on accidents at work.   In addition, the insurance obligation is extended to include the requirement to take out a legal expenses insurance policy.   💡 Keep an eye out on our upcoming Newsflash on the subject! #platformwork #accidents #insurance #Claeysengels

    𝐅𝐢𝐧𝐚𝐥𝐥𝐲, 𝐬𝐨𝐦𝐞 𝐩𝐫𝐚𝐜𝐭𝐢𝐜𝐚𝐥 𝐚𝐫𝐫𝐚𝐧𝐠𝐞𝐦𝐞𝐧𝐭𝐬 𝐟𝐨𝐫 𝐭𝐫𝐚𝐢𝐧𝐢𝐧𝐠 𝐩𝐥𝐚𝐧𝐬 The Belgian Gazette of 2 September publishes the Royal Decree of 14 July in execution of the law of 3 October 2022 concerning the Labour deal.   Among other things, this Decree specifies how the copy of the training plan must be sent to the competent official. A copy of the plan must be sent: ·      To the General Director of the supervision social law of the FPS Employment ·      By means of an electronic application, made available by the FPS Employment ·      With anonymisation of personal data   A ‘transitional’ solution has been provided for the years 2023 and 2024: copies of training plans must be submitted within 6 months of the text coming into force.   The provisions relating to the training plan come into force immediately, on 02 September.   It should also be noted that the Royal Decree of 14 July also specifies the content and procedures for the diversity report introduced by the Labour deal. #LabourDeal #Trainingplan #Execution #Claeysengels

    𝐍𝐞𝐰 𝐥𝐢𝐬𝐭 𝐨𝐟 𝐬𝐡𝐨𝐫𝐭𝐚𝐠𝐞 𝐩𝐫𝐨𝐟𝐞𝐬𝐬𝐢𝐨𝐧𝐬 𝐢𝐧 𝐭𝐡𝐞 𝐆𝐞𝐫𝐦𝐚𝐧-𝐬𝐩𝐞𝐚𝐤𝐢𝐧𝐠 𝐂𝐨𝐦𝐦𝐮𝐧𝐢𝐭𝐲 The new list with shortage professions for the granting of an authorisation to work to third-country nationals employed in the German-speaking Community was published today in the Belgian State Gazette. 78 professions have been recognised as shortage professions. #internationalmobility #claeysengels
