Karine Caunes, CAIDP Europe Executive Director said, "This is both an honour and a responsibility. CAIDP Europe will have at heart to contribute in the human centric implementation of the EU AI Act, based on European values: fundamental rights protection, democracy and the rule of law." 🔥 CAIDP Europe calls for an open & inclusive drafting process 💡 As part of its answer to the European AI Office's GPAI consultation, CAIDP Europe submitted draft RULES OF PROCEDURES to be considered and adopted during the Kick-off Plenary, September 30, 2024. Out of transparency and to foster a necessary debate, CAIDP Europe's proposed Rules of Procedure are available below. 🔥 Key recommendations include: ✅ EQUALITY: equal voice to civil society organisations (CSOs) / independent experts / industry through voting system ✅ TRANSPARENCY: online repository with all contributions and documents accessible to all plenary participants & observes ✅ QUALITY: not only workshops with GPAI model providers but also workshops with CSOs representing affected persons and thematic workshops. Workshops are informational only and shall not replace the Plenary in its drafting function. 👉 The EU AI Act requires a balanced stakeholder representation. 👉 The GPAI Code of Practice aims to tackle the identification, assessment and management of systemic risks to public health, safety, public security, fundamental rights, or the society as a whole. 👉 Should the European Commission approve the GPAI Code of Practice and give it a general validity within the Union by way of an implementing act, the GPAI Code of Practice will become EU law. 💡Civil society, representing affected persons, academics / experts, and industry, including GPAI models providers & downstream providers, should all have an equal say. 🔥 CAIDP AI Policy Clinic Semester #8 Launches With Council of Europe AI Treaty 🎉 This week, we begin the eighth semester of our AI policy clinics at the Center for AI and Digital Policy. When we started in 2021, we had just a handful of people interested in the emerging norms for the governance of AI. Nonetheless, we set out to design a rigorous interdisciplinary course modeled on a law school practicum that would teach policy analysis, research methods, communications strategies, team leadership, and mentoring, all with the goal of training future AI policy leaders. ‼ For the Fall 2024 cohort, we received over 1,200 applicants from over 80 countries. We admitted 357 for our Research Group, selected 45 Team Leaders, and created 15 subgroups with approximately 21 Research Group members in each. 🙏🏼 It is a remarkable story that would not be possible without the instructors, teaching fellows, team leaders, research group members, and academic advisors who have made this possible. Special shout outs to Merve Hickok and Karine Caunes, our dedicated TFs (present and past) Grace S. This week we celebrate the launch of the Council of Europe AI Treaty, the first international treaty for AI that seeks to safeguard fundamental rights, democratic values, and the rule of law. 🗒 In the early days of the CAIDP policy clinics, we discussed the COE AI treaty when it was only a rough proposal. Developing the principles, the scope of coverage, and the monitoring mechanisms would take place over several years. Now there is a formal treaty endorsed by the European Union, Georgia, Moldova, Norway, the United States, the UK, and others. There is work ahead for adoption and ratification. Still, it has been a great experience for those in the Policy Clinics to watch the creation of AI governance in real time. The Greek philosopher Heraclitus once said, "No person ever steps into the same river twice, for the river is not the same nor is the person." Today the European AI Office is launching two key initiatives regarding the drafting of the first EU GPAI Code of Practice. CAIDP Europe calls on civil society organisations, academics, independent experts and concerned citizens to contribute as well. Firstly, a public consultation: https://lnkd.in/efG8zVjD WHAT? 👉 The topics covered by the Code of Practice detailing rules for general-purpose AI models providers 👉 A questionnaire with three sections: 1. General-purpose AI models: transparency and copyright-related provisions; 2. General-purpose AI models with systemic risk: risk taxonomy, assessment and mitigation; 3. Reviewing and monitoring the Codes of Practice for general-purpose AI models. Bonus section: carte blanche / any other relevant aspect to share. FOR WHOM? All interested parties. Eligible general-purpose AI model providers, downstream providers and other industry organisations, other stakeholder organisations such as civil society organisations or rightsholders organisations, as well as academia and other independent experts. WHEN? 👉 Express your interest by 25 August 2024, 18:00 CET. 👉 Iterative drafting process by April 2025. 👉 Code of practice due to apply by August 2nd, 2025. After publication of the Code, the AI Office and the AI Board will assess its adequacy and publish this assessment. The Commission may decide to approve the Code of Practice and give it a general validity within the Union by means of an implementing act. If by August 2nd, 2025, the Code of Practice cannot be finalised or the AI Office deems it not adequate, the Commission will provide common rules for the implementation of the relevant obligations. WHY? Art. 56 EU AI Act: "The AI Office shall encourage and facilitate the drawing up of codes of practice at Union level in order to contribute to the proper application of this Regulation, taking into account international approaches."

🚨 National Court Decision on Facebook: When Competition Law Safeguards Digital Rights🚨 Recently, the Düsseldorf Regional Court made a noteworthy decision regarding Facebook (Meta) and its treatment of users. The court ruled that Meta violated competition law by blocking a user's Facebook account without proper justification. This decision highlights important issues about how big tech companies should operate and protect users' rights. Jurisdiction: Despite Meta’s terms of use suggesting disputes be handled in Ireland, the court ruled it had jurisdiction due to the competition law aspect, allowing German users to challenge unfair practices locally. Abuse of Market Dominance: The court found Meta abused its dominant position by blocking the account without clear and immediate justification, distorting competition and impacting the association's ability to communicate. Need for Transparency: Emphasizing EU regulations like the P2B Regulation and the DSA, the court stressed that platforms must be transparent and fair, providing clear reasons for actions taken against users. Balancing Interests: The court considered factors like the imbalance of power, the social significance of Facebook, and the plaintiff's freedom of expression, finding Meta’s actions unjustified. 📢 European Parliament Sets Up Working Group to Oversee Implementation of the AI Act According to both Euractiv and MLex, the Internal Market and Consumer Protection (IMCO) Committee and the Civil Liberties, Justice and Home Affairs (LIBE) Committee will set up a Working Group to ensure effective implementation of the AI Act. The European Commission plays a central role in the implementation of the AI Act. The Parliament is seeking to ensure the Commission fulfills is its responsibilities. MLEX - "The initiative follows the footprints of similar working groups that were set up to monitor the enforcement of the Digital Services Act and the Digital Markets Act and maintain pressure on the European Commission." Euractiv - "Members of the European Parliament have previously expressed concerns over the lack of transparency around the AI Office’s staffing process, as well as the involvement of civil society in parts of the implementation process."
