As #digitalisation is changing the #automotive sector, in particular the #aftermarket, #competition and #competitiveness still go hand in hand. ADPA contributed to the European Commission's EU Competition Policy DG's public consultation on draft guidelines on exclusionary abuses of dominance. Article 102 of the Treaty on the Functioning of the European Union prohibits dominant companies from engaging in abusive practices that are capable of excluding competitors from the market. This is however one of the few areas of European competition law where no Guidelines clarify yet the application of the rules of the Treaty. These draft guidelines, once finalised, should significantly increase legal certainty, to the benefit of #consumers and #business alike. 📢📢 ADPA argues in particular that: ⚖ With increasing market inequalities, there is a pressing need for effective interventions under Article 102 TFEU to maintain undistorted competition on the internal market. 🔬 Draft guidelines should provide a lot of clear examples of abuses in different sectors - including the automotive aftermarket. 👨⚖️ Deterrence should be increased by speedy, vigorous and active enforcement. 🔍 The European Commission and the National Competition Authorities should pursue much more and smaller cases.

For the last topic on the agenda of the Croatian edition of our Meet-Up event series, we have changed the venue and chosen a slightly more formal setting. Thirty associations representing the multi-brand vehicle aftermarket in Australia (Australian Automotive Aftermarket Association), Brazil (ANDAP - Associação Nacional dos Distribuidores de Autopeças), Canada (Automotive Industries Association of Canada), Colombia (ASOPARTES), India (ACMA India), South Africa (MIWA, Retail Motor Industry Organisation, Right to Repair South Africa, TEPA: Tyres, Equipment, Parts Association), the USA (Auto Care Association, Equipment and Tool Institute (ETI), MEMA Aftermarket Suppliers), and from almost twenty European countries, as well as European associations representing their sectors at European Union’s level (ADPA - Automotive Data Publishers Association, CECRA, CLEPA - European Association of Automotive Suppliers, EGEA - European Garage Equipment Association aisbl, FIGIEFA - Automotive Aftermarket Distributors), have gathered in Frankfurt during #Automechanika 2024, for the Right to Repair Global meeting (R2RG). Over the years, the R2RG meeting has increasingly become a crucial platform for dialogue and collaboration among the associations representing the multi-brand #automotive #aftermarket worldwide. More than just a gathering, this forum actively shapes the future of the industry. A central focus includes addressing common challenges. A significant challenge is for example the need to maintain unrestricted access to Repair and Maintenance Information (RMI), technical information, and the freedom to use tools and spare parts. With the advent of #digitalisation and the emergence of software-defined vehicle, new concerns have arisen, including access to in-vehicle generated #data, the vehicle’s operational functions and resources, the growing absence of repair information for #ElectricVehicle #batteries, and the increasing issue of parts captivity. In this context, vehicle manufacturers gain a competitive advantage by controlling the data generated by vehicles. This control impacts the quantity and quality of information available to independent service providers, ultimately limiting digital opportunities for the businesses and restricting the #freedom of #choice for the #consumers. The participants agreed on the urgent need for a fair playing and robust legislative backing to address these challenges across various regions of the world. In times of recurrent crisis and important pressure on households’ and public budgets, maintaining and even increasing the levels of #competition for such an important budget line as #road #mobility would preserve the purchasing power, while not increasing public expenditure, making it an exceptionally cost-effective public policy. To this end, a robust upgrade of the Motor Vehicle Block Exemption Regulation (#MVBER) regime would be fully in line with the European Commission’s objectives. Against this background, ADPA - Automotive Data Publishers Association welcomes the European Commission’s intention to evaluate the MVBER and its accompanying Supplementary Guidelines. ADPA strongly believes that both market developments (based on technical changes and commercial practices) and enforcement experience mandate to maintain and to modernise the MVBER regime to make it even more efficient and more future-proof, also in line with the European Commission’s objectives for #BetterRegulation. ADPA recommends in particular the following points regarding the scope of the evaluation of the MVBER regime: 🔑 The pivotal role of the MVBER (in conjunction with other European legislation) and its essential role for independent operators and consumers alike should be assessed; 🔎 While #digitalisation is an important factor for competition today and tomorrow, the legacy items such as access to technical information, servicing of vehicles under #warranty and trade in spare parts still deserve close monitoring; 🚧 Commercial and technical barriers to competition, resulting in particular from new trends such as digitalisation and #electrification, should be taken into account; 👩⚖️ Legal uncertainties and inadequate alignment resulting from the coexistence of different legislations should be identified, as well as potential remedies; 💡 The international lighthouse effect of the MVBER should be taken into consideration. In terms of procedure, ADPA recommends that: 🗓 The public consultation should take place no earlier than the last quarter of 2024, and last at the very minimum 12 weeks; 🏛 National Competition Authorities should continue to be closely associated with the review process; 🎙 The European Parliament, in its consultative capacity and given the political importance of the matter, should also be associated.

ADPA - Automotive Data Publishers Association publishes its #Manifesto for the #EuropeanElection, calling the upcoming European lawmakers to improve the #safety, the #sustainability and the #affordability of #road #mobility during the next term. The European #automotive #aftermarket is facing increasing and unnecessary challenges putting at risk #competition, with #consumers lacking choice as to where to get their vehicles serviced, repaired and maintained. This situation endangers a vibrant #ecosystem providing more than 3.000.000 #jobs in 500.000 #companies all over #Europe, ensuring the quality of mobility for #people and #goods alike. The European Parliament and the European Commission could easily and significantly remedy this with appropriate, proportionate measures, improving competition, safeguarding consumers’ interest, while not creating unnecessary burdens.
