From today, significant changes to the Family Law Act will help to create better outcomes for children and families affected by family law proceedings. The Family Law Amendment Act 2023 (Cth) (Family Law Amendment Act) and Family Law Amendment (Information Sharing) Act 2023 (Cth) (Information Sharing Act) aim to make it easier for parents and courts to determine parenting arrangements that are safe for children, and put their best interests first. Under the Family Law Amendment Act, family courts will no longer apply the ‘presumption of equal shared parental responsibility’ except in matters where final hearings have already commenced. The new laws also contain a simplified list of ‘best interests’ factors that will guide a court’s decision‑making on parenting orders. The Information Sharing Act establishes an enhanced framework for sharing information relating to family violence, child abuse and neglect risk to family law courts from state and territory police, child protection and firearms agencies. Starting 1 October 2024, new fees will kick in, including revised costs for patents, trademarks, and design rights proceedings. Wʜᴀᴛ’ꜱ Nᴇᴡ? If you’re filing an examination request after this date and have more than 20 claims, expect to 𝗽𝗮𝘆 𝗲𝘅𝗰𝗲𝘀𝘀 𝗰𝗹𝗮𝗶𝗺𝘀 𝗳𝗲𝗲𝘀 𝘀𝗼𝗼𝗻𝗲𝗿. You’ll get a notice after the first examination report, and you’ll need to pay up within a month or risk your application lapsing. Gᴏᴏᴅ ᴛᴏ Kɴᴏᴡ: IP Australia will give you a heads-up about six months before they start examining your application, so you have time to tweak your claims and avoid extra fees. #IPAustralia #PatentFees #TrademarkFees #DesignRights #LegalUpdate
