Effect of belated acknowledgment of the Expert Witness Code of Conduct In Mahadik v Jones [2024] NSWLEC 1411, respondents engaged Mr DJ, an expert arborist, who issued a report without acknowledging the Expert Witness Code of Conduct within the report itself; this was documented separately afterwards. The court said that a delayed acknowledgment of the Code may suggest the report was not prepared with its standards in mind. The court referenced prior cases suggesting that if an expert affirms their report after acknowledging the Code, the report could still be admitted into evidence, provided the court finds the affirmation credible. In this case, Mr DJ failed to meet the Code’s requirements by not providing complete details of all investigations and not clearly outlining the critical assumptions of his risk assessment. Consequently, his late acknowledgment of the Code seemed merely formal, leading the court to conclude that his report lacked the weight of an expert report.
