🇦🇺 PSA: The new 'same job, same pay' law is coming into effect from today (1 November, 2024). This means that thousands of employees across industries like mining, aviation, warehousing, and meat processing are set for substantial pay increases, totalling tens of millions of dollars. What’s driving this change? In the past, some employees performing the same role were paid differently based on whether they’re paid directly from an employer, or via a labour hire company. The new law means that: 🟣 Employers with enterprise agreements cannot use labour hire companies (who the enterprise wouldn't apply to) to avoid paying the higher wages set out in the enterprise agreement. 🟣 Instead, a labour hire company used in these circumstances would need to pay their employees as if the enterprise agreement applied to them too. What does that look like in practice? It’s been reported that around 800 Qantas cabin crew members are eligible for a 28% pay rise, and other employees from other companies have reported receiving up to a 60% increase. This is just one of the many legislative changes that has come into effect under the Closing Loopholes Bill. With more set to come into effect in 2025, it’s critical that employers in Australia are across their legal obligations.
