The UAE issued its first Economic Substance Regulations (ESR) in 2019 to comply with international initiatives to combat harmful tax practices, including unlawful tax avoidance and evasion. Now that the UAE has a full structure in place for its corporate tax requirements, separate reporting for ESR is no longer required for periods from 1st January 2023.   However, it should be noted that the requirement to demonstrate economic substance has not disappeared entirely. We are delighted to have welcomed a joint delegation from The Cairo Regional Centre for International Commercial Arbitration (CRCICA), Hamburg Chamber of Commerce, and the LawCom.Institute to our Cairo office in a recently held roadshow. The discussions focused on the introduction of the African-German Arbitration Cooperation (AfGAC) project, and exploring opportunities for collaboration to ensure its success. Attended by AMERELLER partners Sherif El Saadani, Ingy Rasekh, Nisreen Karyouti, Aziz Abaza, Hend Zaghloul and Nariman Roushdy and by the esteemed delegation members Mr. Karim A. El-Rouby, Ms. Linnéa Harting, Dr. Jan Curschmann, Judge Friedrich-Joachim Mehmel, Mr. John Nyanje, and Mr. Christian Graf, the meeting highlighted the critical role of arbitration in fostering cross-border legal cooperation between Germany and Africa especially at a time when economic ties between these economies continue to grow. In August 2024, the Egyptian Competition Authority for the first time issued guidelines on vertical constraints of competition. Kilian Bälz, Nisreen Karyouti, and Mazin Ezzeldin discuss what this entails for international distribution and supply agreements with Egyptian parties. In a significant legislative development, Saudi Arabia issued Cabinet Decision No. 93/1446 enacting two new laws: the Standards and Quality Law and the Product Safety Law. These laws define the obligations on manufacturers and importers, expand the authorities of the regulator, and establish a dedicated committee to enhance product recall coordination and consumer safety. The laws will come into effect on 16 November 2024. Egypt has promulgated earlier this year its Incentives for Green Hydrogen and its Derivatives Production Projects Law No. 2 of 2024. The Green Hydrogen Law aspires to position Egypt as a hub for green hydrogen production, capitalizing on its existing infrastructure, and green hydrogen potential, to satiate clean energy needs of adjacent markets, particularly the EU. The law also aims to advance sustainable social and economic development while limiting carbon emissions, in addition to establishing a favorable investment environment and facilitating procedures that attract foreign investors.
