The stepchildren of a woman killed in a fatal accident involving Caitlyn Jenner claim that they can produce a statement from a witness saying that Jenner was “driving erratically” in the moments prior to the crash.
In court papers filed this week, Dana Redmond and William Howe, who are suing Jenner for wrongful death, cite footage of the crash captured by a bus that was traveling near the accident that killed Kimberly Howe, which was published on Thursday.
Redmond and Howe also mention a witness statement in the filing this week.
“To date, Ms. Jenner has refused to accept responsibility for causing this collision,” the filing states. “Plaintiffs have obtained video of the collision from [a] Metro bus which happened to be in the area at the time of the collision. Plaintiffs have also obtained a statement from a witness who described Ms. Jenner driving erratically just prior to the crash.”
Howe was killed in a Malibu, California, crash in February. The suit filed by her stepchildren alleges that Jenner’s vehicle hit Howe’s car, pushing it into oncoming traffic. According to the suit, her death “caused plaintiffs to suffer enormous damages and losses.”
Jenner has contended that Redmond and Howe weren’t financially dependent on the victim and thus are not entitled to damages in Howe’s death.
In a statement to TheWrap, attorneys for Redmond and Howe said that the bus video “shows an aspect of reality that Ms. Jenner continues to deny.”
“This video shows an aspect of reality that Ms. Jenner continues to deny. Our clients are moving forward with this lawsuit to give a voice to Kim Howe who was killed as a result of Ms. Jenner’s actions,” the statement reads. “Ms. Jenner has failed to appear for her noticed deposition, so we are surprised to hear that she intends to cooperate in every way possible with this investigation. We encourage Ms. Jenner to be that role model that she seeks to be. That means accepting responsibility for what she has done.”
