If SMS marketing isn’t part of your company’s strategy yet, it’s time to ask yourself why your organization is not using this powerful tool.... TrueDialog CTO Navid A. recently reported in Forbes that: Ninety-one percent of consumers want to receive texts from businesses. The average SMS open rate is 98%. SMS can generate $71 for every dollar spent. Ninety percent of people respond within 30 minutes of getting a text message. Fifty-one percent of people say they are likely to make a direct purchase from a text message. Meanwhile, 61% of businesses fail to use SMS as part of their marketing strategy. One of the reasons many marketing professionals shy away from SMS marketing is concern that consumers will perceive SMS as unsafe. The good news is text message regulations are actually stricter than those for email. SMS rules stated in the Telephone Consumer Protection Act (TCPA), which governs how telemarketers can reach consumers, include: Consumers must opt into receiving text messages. Companies are responsible for confirming enrollment with a message that explains the customer has signed up for recurring notifications. Your company must make it easy for consumers to opt out of text marketing. Content must be appropriate and relevant. All content must adhere to state and federal laws. Some types of organizations, such as colleges and universities, have additional SMS regulations to follow. In addition to TCPA regulations, mobile carriers protect consumers from spam and malicious SMS by using filters. As long as you maintain compliance, texting is a safe and strictly regulated way for consumers to confidently engage with brands. Legal requirements for marketing email can vary country by country. In some countries, you are required to get consent before sending marketing emails, and in other countries consent is not required. However, in nearly every country, the one thing you do need to include in your marketing email is a functional unsubscribe mechanism, allowing recipients to opt out of receiving additional marketing emails from your organization in the future. Whatever unsubscribe mechanism you choose, test it periodically to make sure it works, and make sure to opt out recipients promptly (within 10 days of receiving an opt out request). Only 35% of Brands Have a Formal SMS Messaging Strategy in Place. Put compliance at the forefront of your strategy. Before sending any text messages, you should make sure your program meets legal and regulatory compliance standards. At a high level, SMS marketing compliance requirements in the US include the following: Your subscriber must explicitly opt-in for SMS marketing in writing. This opt-in has to be a separate from email marketing. You must clearly explain to potential subscribers what types of messages they’ll receive and how to opt out. You must respect opt-out requests. You can’t send text messages during federal- and state-specific “quiet hours." The absence of a formal strategy suggests that many brands could be missing out on the benefits of SMS marketing, such as: High engagement rates: SMS messages have been known to have higher open rates than other digital communication forms. Immediate reach: Text messages are typically read within minutes, making it a swift channel for reaching consumers. Regulations governing commercial email vary widely country by country. In the US, you can send marketing emails to US residents without obtaining permission from the recipient, as long as you provide a mechanism allowing the recipient to unsubscribe from receiving emails in the future. In the EU, you need to obtain affirmative consent before sending marketing emails. Some other countries take the US "opt out" approach, and others have adopted the EU "opt in" method. Given that the rules vary based on the location of the recipient, you should factor consent requirements into your marketing strategies. Noncompliance can not only get you into trouble from a regulatory perspective, but can also negatively impact your customer relationships.
