After a lengthy tug-of-war between the US federal District and Ninth Circuit appellate courts in Oregon, the nine-year long case of Juliana et al v United States of America et al was dismissed by the United States Court of Appeals for the Ninth Circuit, leaving the District Court and Plaintiffs no means to keep the suit alive. Emma Ager, Lisa Somervail, Lucia Williams and I explore the commercial and constitutional implications of this dismissal on US climate change litigation, and it’s potential impact on allegations made by plaintiffs in ongoing lawsuits and future claims for coverage. 🌎 This landmark decision forms part of the growing body of international climate change litigation seeking to hold governments and private entities to account for their action, or inaction, on climate-related issues. In the article below, Claire Smith, Emily Tranter, Darcy Bradley, Jennifer Williams & I reiterate how this decision could have global implications for climate-related litigation, and why decision-makers should consider whether they are at risk of: 🌱 challenges to climate policy that lack ambition, or a failure to implement climate targets, policies or legislation; and 🌱 challenges to development or environmental approval decisions that impede human rights. ____________________________________________ Clayton Utz, Future Farmers Network (FFN), Cattle Australia, Agribusiness Australia, Queensland Farmers' Federation, National Farmers' Federation, Department of Agriculture, Fisheries and Forestry, Department of Agriculture and Fisheries (Queensland), Department of Agriculture and Fisheries (Queensland), AuctionsPlus
