I’ve spent my entire career working with the legal industry, primarily litigators from the AmLaw firms as well as in-house attorneys. Every year you see the same messaging in the industry: --> In-House counsel are finding more creative ways to manage outside counsel spend - budget keeps disappearing and more work is being done in-house --> Law firms are trying to find ways to get more competitive while also increase rates (and that’s been very apparent over the last 3-5 years with innovative technologies not only being used to help save the lawyers time, but built to support their in-house client community) In the last few years I’ve become intimately familiar with just how high those bills with outside counsel can be for litigated matters. Is it an impeccable work product completed by someone who has an expertise in this particular area and is well worth it? 10000% no argument there. However, there’s other steps you can take to ensure your law firm bills are more manageable and more predictable. The last several years of my life have been dedicated almost exclusively to managing legal spend, without sacrificing quality or level of service. I went from managing in-house spend on contract review to automate the obscene amount of NDAs/MSAs/POs/alltheacryonyms with AI to helping outside counsel manage spend on eDiscovery matters based on TB rather than user count or number of applications. I’m back for more with court reporting. In-house community, I’ve worked with you for years. You know panels of approved vendors aren’t exactly a new concept ..they’re being used by almost every insurance company in business today. You don’t have to be in insurance to dictate the services you want your law firm to use for you. I am here to help make your spending more predictable. Litigation happens. Sometimes it’s anticipated, often times it’s not…but it’s always expensive no matter how you slice it. Recently had a discussion with a defense attorney. DA: will you agree to dismiss the individual defendant? They’re not a proper party under the tort claims acts. ME: Sure, but only if you will stipulate that the defendant was in the course/scope of his employment. DA: this is a standard request and 5 other attorneys have agreed in the last week. No one has asked for a stipulation. That’s an abnormal request. ME: Cool. But if the individual defendant wasn’t in the course/scope, then he’s a proper defendant under the statute. So will you stipulate? DA: no one is saying he wasn’t in the course/scope. There’s no allegation otherwise. ME: except your answer denied him being in the course/scope. So how about the stipulation? Alternatively, amend your answer to admit he was in the course/scope. I don’t my care which way we go, but let’s avoid this silly hearing on your motion to dismiss. DA: I can’t amend my answer. This is ridiculous. ME: Sure you can. You have my permission to amend your pleading. Just admit course/ scope. And let’s avoid the unnecessary hearing. DA: I’m not going to argue he wasn’t in course/scope. Again, there’s no allegation otherwise. ME: ok. But let’s look at your answer where you literally deny it. If there’s no allegation otherwise, then stipulate to it or amend the answer. But otherwise, we’re going to the hearing. DA: I’ll have to check with my client. ———————- Something tells me I’m going to a hearing next week where the judge is going to hear how I’m unreasonable, but yet they refuse to certify course/scope. And I know what’s going to happen--the motion will be denied for the obvious. Then the amended pleading or stipulation will come next. I’m never impressed with everyone does it, you should too argument. Moreover, if others are stipulating without course/scope certification, then you have a state entity who can say at trial that crashing into people is not part of their job. And a jury could plausibly agree. Then the plaintiff attorney should hand over the malpractice insurance info to their clients explaining why the jury faulted the driver, exonerated the state entity, and the verdict is worthless. I think too many of us agree to things because we don’t want to be unreasonable and apparently others agree blindly. But that should never be a guiding principle for making a bad decision.

What is the difference between plaintiff and defense attorneys? Is it justice warriors vs. devil’s advocates? Not so fast. A popular (and simplified) picture suggests plaintiff attorneys are fighting for the good, while civil defense attorneys represent the bad guys. Think of personal injury cases. A plaintiff's attorney advocates for their client's rights, seeking rightful compensation for the injuries they suffered. On the other hand, an opposing counsel defends the greedy insurance companies, helping them minimize or deny compensation and preserve their profits. This black-and-white picture rarely reflects the reality. Unlike in my country, where attorneys represent both sides (not in the same case), US attorneys tend to specialize, choosing to represent either the plaintiff or the defendant. But the differences between them are pragmatic, not metaphysical. It all boils down to two issues: passion for litigation and financial considerations. 1. Passion for Litigation The crucial question here is who the driving force in the court is. In other words, who has the initiative in litigation? As a defense attorney, you will more likely have the autonomy and passion for uncovering the holes in the other side’s strategy. The party you represent is more or less passive as long as you get the job done. On the other hand, plaintiff attorneys can be great litigators, but the party they represent is the one who's passionate about each aspect of the case. Because they are heavily emotionally invested and want vindication, plaintiffs are much more involved in the process. The attorney’s job is to act as a voice of reason, trying to put passions aside and focus on the strategy that will result in the maximum compensation. 2. Financial Considerations Defense attorneys typically work on hourly fees. The volume of the case is irrelevant, and so is its outcome. You will get paid for the hours you spend working on a case. In such an arrangement, attorneys are less emotionally engaged in the process, but the stress comes from the need to meet billable hour requirements. Conversely, most plaintiff attorneys’ work is contingency-based. Your fee depends on the outcome of the case. If your client recovers the damages, you will get paid. If not, all your hard work is in vain. While defense attorneys can have an interest in prolonging the case, their plaintiff counterparts know that spending too much time on one case means less time to take another case. 💡Which side do you represent in court? Defense lawyers can't fix stupid. I have had a lot of success litigating premises liability cases against various companies over the years. My success hasn't come from complex or novel legal strategies or anything like that. My success has come from the dumb employees that work for the Defendant. It's funny because many times the Defendant (and their insurance overlords) will hire top-tier law firms to represent them in the case. Lawyers with admirable legal pedigrees and significant trial experience. But unfortunately (for the insurance company) Defense lawyers can't fix stupid. I had a case where the lawyer from a big fancy firm, (Old White Man, White Man, & Associates) filed a well-researched and thoroughly written motion for summary judgment on a "rainy day" slip and fall case. Unfortunately, Defendant's employee testified, "Yeah, I knew the floor was wet before the customer walked it, but I didn't clean it up because I was busy and that's someone else's job to clean the floor." That motion was denied and we proceeded to trial. Another case, a lawyer from an even fancier defense firm (Even Older White Man, White Man, & Associates) filed a well-researched motion for summary judgment as well. Unfortunately, the discovery revealed that shortly after my client was injured, the Store Manager called my client on the phone and said, "Well, I guess one of my employees must've put the (50 lbs object) on the wrong shelf and it fell on you." That motion was denied and we subsequently settled for a reasonable amount. So the moral of the story is: never be intimidated by how many lawyers the insurance companies throw on a case or even how experienced opposing counsel is. The key is to dig deep and reveal how an employee's screw-up caused your client's unnecessary injury. Because Defense lawyers can't fix stupid.
