In NPR v. CENTCOM, a FOIA case seeking records related to a coverup over the worst friendly fire incident in modern history during the Iraq War, the Ninth Circuit reversed the lower court’s earlier judgment in favor of CENTCOM, finding that it must search its unclassified networks for relevant records. The case was successfully argued by Caesar Kalinowski IV, with oversight by Thomas R. Burke, and key support from commercial litigators, Jean Fundakowski in San Francisco, and former DWT litigator Andrew Row.
