In Hausfeld’s Spring Competition Bulletin, Irving Scher and Farhad Mirzadeh explore how loyalty discounts can be considered de facto exclusive dealing arrangements in violation of the antitrust laws. The article highlights a common distribution practice – loyalty discounts – which have received little scrutiny from the courts. An interesting case here reminiscent of the 'old' supermarket wars - I hesitate to say when that was but let's say circa early/mid noughties - to do with alternatives/competing proposals with Lidl and Aldi involved. A potentially sticky issue, which is very fact sensitive as the below judgement reminds us, and which commonly comes up in the context of giving advice as to whether LPAs should wait to determine applications together, or deal with them in turn when, say, they are ready for committee. The outcome? See para 102: "I agree...that adopting a 'first past the post' approach does not satisfy the need for a coherent way of determining which of the rivals should be preferred.
