“Both parties have agreed to part ways amicably and Mr. Brafman has agreed to cooperate fully with new counsel for Mr. Weinstein so as to ensure an orderly transition,” Weinstein and Brafman said in the joint statement. “Mr. Weinstein praised Mr. Brafman for his legal work to date and Mr. Brafman reiterated his belief that Mr. Weinstein would be exonerated of the charges that have been filed against him and Brafman personally wished Mr. Weinstein the best of luck as he defends the case and the accusations that Mr. Weinstein has vehemently denied.”
Weinstein added that he will announce his new legal team by early next week.

A New York judge rejected a request from Harvey Weinstein’s lawyers to throw out charges that he sexually assaulted two women, Variety reports.
Weinstein’s lawyers have accused one of the alleged victims of lying, while they have also accused the Manhattan District Attorney’s office of not turning over evidence that would supposedly show a consensual relationship between Weinstein and his accusers. After a private meeting with the prosecution and defense Thursday, Judge James Burke rejected the request and set a pre-trial date for March 7th.

A week before a hearing that could decide the fate of the Manhattan District Attorney’s rape case against Harvey Weinstein, the primary lawyer for the much-accused producer today attacked the alleged victims and prosecutors.

The Manhattan district attorney’s office is urging a state Supreme Court judge to reject Harvey Weinstein’s call to dismiss all of the remaining sex-crimes charges against him.
District Attorney Cyrus Vance Jr.’s office strenuously objected to Weinstein’s legal argument that the entire grand jury process had been tainted by police misconduct and perjury by one of the accusers in a court filing today.
Prosecutors moved to dismiss one of the sexual assault charges last month, after acknowledging that the lead detective in the case had committed an error — he failed to tell them about other witnesses who cast doubt on the credibility of one of Weinstein’s accusers, Lucia Evans.
In today’s legal filling, the prosecutors argue that the remaining criminal charges rely on other evidence that is independent of Evans’ testimony, and therefore not sullied. Indeed, the grand jury was instructed to treat those allegations separately,...

The criminal case against him hit a snag earlier this month when the prosecution threw out the charge of Lucia Evans, one of three women who have spoken out against him in the case. Meanwhile, Weinstein is looking to settle various civil cases against him out of court.

A Manhattan judge dismissed one of six criminal charges against Harvey Weinstein Thursday, The New York Times reports. The dropped charge relates to an allegation brought by Lucia Evans, who claims Weinstein forced her to perform oral sex on him in 2004.
Prosecutors said that they uncovered inconsistencies in statements made by one of Weinstein’s accusers, though the report did not specify what those inconsistencies were. Weinstein’s lawyer, Benjamin Brafman, also argued that the grand jury had not been given evidence regarding Evans’ accusation before deciding to indict the disgraced Hollywood mogul.

Harvey Weinstein Gets A Big Win As NY Judge Dismisses One Count And Gives Defense More Time To Fight
(Updated with unsealed D.A. letter to defense lawyer) Harvey Weinstein appeared without handcuffs in New York Supreme Court this morning and even flashed a faint smile, a big change from his previous sober and shackled appearances in his sexual assault trial.
The fallen mogul’s more upbeat demeanor suited the outcome of the day. Judge James Burke dismissed one of the six counts against him after the Manhattan D.A. agreed to drop it, and also pushed a key ruling to December, giving the defense more time to fight the charges.
The ditched sexual assault count stemmed from allegations by Lucia Evans, who told the New Yorker a year ago that Weinstein forced her to perform oral sex in his office in 2004. At the time, she was a 21-year-old student and aspiring actress.
Weinstein’s legal team will have until November 16 to file further motions attacking the remaining charges against him.

Rich McHugh is speaking out against NBC News just a few weeks after leaving the company’s investigative unit. McHugh, a producer for NBC News, worked with Ronan Farrow on the investigation into Harvey Weinstein’s history of sexual abuse and harassment for an NBC News story, but he says the network effectively killed the investigation.
“At a critical juncture in our reporting on Harvey Weinstein, as we were about to interview a woman with a credible allegation of rape against him, I was told not to do the interview and ordered to stand down, thus effectively killing the story,” McHugh said in the statement to CNN.
McHugh maintains NBC told him to stop the story three days before he was set to interview a credible source. The producer alleges NBC ordered him “not to interview” the woman with rape allegations against Weinstein and “to stand down on the story altogether.

NBC News on Thursday night denied an accusation by a former producer that top executives tried to block Ronan Farrow’s 2017 exposé of Harvey Weinstein, calling the claim “an outright lie.”
“The assertion that NBC News tried to kill the Weinstein story while Ronan Farrow was at NBC News, or even more ludicrously, after he left NBC News, is an outright lie,” read the NBC statement.
Earlier Thursday, Rich McHugh, a producer formerly of the NBC News investigative unit, told the New York Times that people at “the very highest levels of NBC” worked to quash the story at the network.
McHugh said the network was “resistant” during the eight months or so that he and Farrow investigated Weinstein for the story. But in August 2017, when they were set to begin recording the accounts of Weinstein accusers on video, McHugh said the network abruptly pulled support.

NBC News faced similar opprobrium in the fall of 2016 when it was scooped by The Washington Post on the existence of a tape from “Access Hollywood” – a show that is part of NBCUniversal – that depicted a younger Donald Trump making lewd remarks about women and acknowledging he would grab them by their genitals.

Harvey Weinstein’s attorneys filed a motion to dismiss his sex crimes indictment on Friday, arguing that prosecutors erred by not showing the grand jury friendly emails between Weinstein and one of the alleged victims.
Weinstein’s attorney, Benjamin Brafman, obtained permission Thursday from a Delaware bankruptcy judge to include the emails in the motion. The accuser, who contends that Weinstein raped her in a hotel room in 2013, is identified in the motion as “Complaining Witness 1.” Brafman has previously said that the woman had a consensual 10-year relationship with Weinstein.
The motion quotes about 40 emails from her to Weinstein, in which she discusses getting together and comments on their relationship:
“I love you, always do. But I hate feeling like a booty call,” she wrote in 2017, according to the motion.
“I was hoping for some time privately with you to share the direction I am going in life and catch up because its been awhile,...

Exclusive: Over a month before he is scheduled to be back in court on sex crime charges that could see him behind bars for life and less than an month after he last pled not guilty, Harvey Weinstein today took a big swing at having the whole grand jury case dismissed.
“Mr. Weinstein categorically denies that he had non-consensual sex with any person, and specifically the three accusers in the pending indictment,” declared the producer’s primary lawyer Benjamin Brafman in a highly charged motion filed in New York Supreme Court on Friday morning.
“The pending indictment against Mr. Weinstein must be dismissed at the pretrial stage because it is legally infirm based on the District Attorney’s failure to provide exculpatory email evidence to the Grand Jury; failure to give adequate notice to the defense as requested that it was presenting new, far more serious charges to the Grand...

Harvey Weinstein pled not guilty to sexually assaulting a woman in 2006 during an arraignment in downtown Manhattan on Monday.
It was a familiar scene for the 66-year old movie mogul. He had previously been arraigned in June on charges of first- and third-degree rape, and a first-degree criminal sexual act involving two other women. The charges stem from incidents that allegedly took place in 2004 and 2013.
A handcuffed Weinstein entered the court room on Monday wearing a dark suit, a white shirt, and a navy blue tie. He looked ashen and appeared to have shed some weight from his hulking frame. He was flanked by his attorney Benjamin Brafman, and whispered to him at various points during the arraignment.

As expected, accused rapist and disgraced former Hollywood mogul Harvey Weinstein pled not guilty on to charges of rape and other acts of sexual misconduct during a Tuesday morning arraignment at New York’s Supreme Court.
The appearance marked Weinstein’s second appearance at the court in the space of two weeks, as he was arraigned late last month on charges of rape, a criminal sex act, sex abuse, and sexual misconduct. Variety reports that Weinstein “arrived at a Manhattan court house to enter his plea, while wearing a dark suit and limping slightly. Five days after being arraigned and posting $1 million bail, Harvey Weinstein was indicted Wednesday by a Manhattan grand jury, Variety reports. The former Miramax and Weinstein Company co-chairman now formally faces two rape charges — one first-degree, one third-degree — plus one charge for criminal sexual acts. If found guilty, the 66-year-old could earn up to 25 years imprisonment.
New York County District Attorney Cyrus Vance Jr. said in a statement, “This indictment brings the defendant another step closer to accountability for the crimes of violence with which he is now charged. Our office will try this case not in the press, but in the courtroom where it belongs. The defendant’s recent assault on the integrity of the survivors and the legal process is predictable. We are confident that when the jury hears the evidence, it will reject these attacks out of hand.”

Harvey Weinstein has elected not to testify to a grand jury convened by the Manhattan District Attorney’s office, his attorney announced Wednesday.
Weinstein was charged in a criminal complaint on Friday with two counts of rape and one count of a criminal sexual act. He is free on a $1 million bail, and restricted from traveling outside New York and Connecticut. A grand jury is convening to determine whether to issue an indictment on the same allegations. Weinstein’s decision not to testify is not a surprise, as it would be unusual to offer his version of events at this stage of the proceedings.
Weinstein’s attorney, Benjamin Brafman, did offer a glimpse of his defense, saying that one of the cases is 14 years old and the second involves a victim with whom he had a consensual relationship. In the statement, Brafman also objected to being denied access to “critical...

The woman alleging Harvey Weinstein repeatedly raped her in 2013 had a consensual sexual relationship with him for 10 years ... according to Weinstein's attorney. Ben Brafman met with prosecutors and the judge Tuesday, and afterward said he was baffled by the charges because the unnamed accuser carried on her relationship with Weinstein before and after the alleged rape in a hotel room. He also expressed concern about the indictment against Weinstein ... claiming prosecutors had bowed to immense public pressure.

The arrest of Harvey Weinstein feels like the beginning of what justice should look like for his accusers. It’s also symbolic for survivors of sexual violence everywhere that a person of his stature has to answer for his actions. It provides hope for other people that they might have some recourse in their everyday lives. That’s one of the most powerful things about this moment.
I don’t think, however, that this is a moment to revel in how the mighty have fallen. It’s really about the power of community and the power of survivors of sexual violence raising their voices and standing together. It wasn’t one claim. It wasn’t one singular voice. It was a chorus of voices that started rising little by little and crescendoed into this massive chorus. It resulted in what we saw today. And let’s not forget to say...

Harvey Weinstein was charged on Friday morning with three felony counts of rape and criminal sex. Here’s what we know about the accusations behind the two rape charges.
One rape charge is first degree, the other is third degree. They stem from an unidentified accuser who said Weinstein kept her against her will and sexually assaulted her in a room at the DoubleTree Metropolitan hotel in midtown Manhattan in 2013.
According to the criminal complaint, filed Friday by Manhattan Assistant Da Joan Illuzzi-Orbon, Weinstein “kept informant physically against her will in a room and engaged in sexual intercourse with informant by forcible compulsion, to wit, defendant penetrated informant’s vagina with his penis and, at the time of the incident informant had clearly expressed her lack of consent to the act.” The complaint says the incident happened on March 18, 2013 at 569 Lexington Ave (the address of the DoubleTree Metropolitan Hotel).

In a modest courtroom in lower Manhattan, the normally voluble Harvey Weinstein had only one word to say during his 10-minute arraignment: “Yes.” Two hours after turning himself into the police, and nearly eight months after a pair of damning exposes in the New York Times and The New Yorker, Weinstein faced charges of rape, a criminal sex act, sex abuse, and sexual misconduct before Judge Kevin McGrath, who asked the accused if he understood the terms of an order of protection put in place for the safety of one of his unnamed victims.
