Fair use rationale

It is considered that it is a fair use of a low resolution image to accompany an article on the work itself, Everyone I Have Ever Slept With 1963–1995. The work is an important and well known piece of art that has attracted much public attention and is considered by the artist to be one of her two major and "seminal" pieces of work. It was destroyed in the 2004 Momart warehouse fire; thus no new photographs of it can be taken. It is believed that this use does not infringe copyright. There is no known free alternative available. According to section 107 of the United States Copyright Act of 1976: The fair use of a copyrighted work...for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. [1] The image is used for non-profit purposes. This factor is noted as relevant by the Act.
