Fair use on America (band), America (album) and A Horse with No Name
[edit]The image in question is subject to a copyright. However, the use of the image on these three articles qualifies as fair use for these reasons:
- It is a low-resolution copy of an album cover
- It does not limit the copyright holder's ability to sell the album in any way
- There is no free alternative to replace the use of this image
- On America (album), there is no substitute for the cover image
- On A Horse with No Name, there was no separate cover art for the single, so the album from which the single came from is the only choice
- On America (band), it is the only way to depict the band's lone #1 album.
