Allegations of Genocide under the Convention on the Prevention and Punishment of the Crime of Genocide (Ukraine v. Russian Federation) is a court case at the International Court of Justice (ICJ), the principle judicial organ of the United Nations. The case was submitted by Ukraine on February 26th 2022 against Russia following the latter's invasion with regards to a dispute concerning the 1948 Convention on the Prevention and Punishment of the Crime of Genocide.
Charges
The Ukrainians petition the court on two fronts. The first is that counter to Russian claims,[1] acts of genocide have not occurred within Luhansk and Donetsk oblasts. As these assertions are the basis of Russian recognition of Donetsk People's Republic and the Luhansk People's Republic and the subsequent Special Operation is not justified. The Ukrainian view is that by the court determining this, it would "establish that Russia has no lawful basis to take action in and against Ukraine for the purpose of preventing and punishing any purported genocide."[2]
The second is accuses the Russian government of "planning acts of genocide in Ukraine" and asserts that during the invasion the Russian Armed Forces are "intentionally killing and inflicting serious injury on members of the Ukrainian nationality the actus reus of genocide under Article II" of the Genocide Convention.[2]
Proceedings
Initial hearings on the case took place on March 7th, 2022 in The Hague Peace Palace, the seat of the court.[3] The Russian delegation did not appear for these proceedings.[4]
