Do not copy this file to Wikimedia Commons. There is no freedom of panorama (FOP) for copyrighted 3-D works of art in the Philippines. Such works of art include mansions, monuments, sculptures, memorials, pavilions, contemporary buildings, and others that were: a) created or designed by people who are still living or have been dead for less than 50 years, or b) built by architectural firms (if no specific person is mentioned or identified) for less than 50 years (please see both the Wikipedia page "copyright law of the Philippines" and the Wikimedia Commons page discussing the lack of freedom of panorama in the Philippines). As long as the depicted 3-D work of art is still copyrighted (not yet in public domain) or there is no FOP in the country, this photo should not be transferred to Wikimedia Commons. Although Insular Life Building (Makati) was completed in 1962 with a design by Cesar Concio (died 2003; the 1962 period was before the promulgation of Presidential Decree No. 49 in November 1972 that mandated copyright protection for all works of intellectual property in the Philippines, including architecture and sculptural works, although non-retroactive with respect to no actual lawsuits from creators), this building was "redeveloped" in 2005 with a "new design" from Takenobu Mohri Architects and Associates. In effect the design of this building dates from 2005, not from 1962. |
This file will not be in the public domain in both its home country and the United States until January 1, 2056 and should not be transferred to Wikimedia Commons until that date, as Commons requires that images be free in the source country and in the United States. |
